Is it illegal to carry a passenger in the trunk of a car?

Công LuậnCông Luận25/09/2024

According to the law, traffic participants must comply with safety rules. Specifically, people in cars must sit in the correct seat position and wear seat belts if equipped.

The trunk of a car is designed to hold goods, not people. Even the trunk of a pickup truck is designed to hold goods, not passengers.

Carrying people in the back of a car or on the bed of a pickup truck is a serious violation that can endanger the lives of those sitting in it while the vehicle is moving. Especially in unexpected situations such as sudden braking, cornering or encountering potholes, people sitting in these positions are very susceptible to serious injury.

According to the provisions of Point c, Clause 2, Article 24, Decree 100/2019/ND-CP dated December 30, 2019, the act of transporting people in the vehicle's trunk in violation of regulations is subject to the following penalties:

Fines from VND 800,000 to VND 1 million shall be imposed on drivers of trucks, tractors and similar vehicles who carry people in the vehicle's bed in violation of regulations; let people lie or sit on the hood, or hang on the outside of the vehicle while the vehicle is moving.

In addition to being fined, drivers of violating vehicles may also be subject to additional penalties such as having their driver's license revoked for 1 to 3 months.

Authorities advise drivers to never carry people in the bed of a pickup truck, in the trunk, or anywhere not designed to carry people. Sudden braking, cornering, or collisions can all have serious consequences.

Carrying people in these unsafe positions not only endangers the occupants but also affects general traffic safety.
