Chairman of the Provincial People's Committee commented on the draft Decree implementing the Law on Geology and Minerals

On the morning of May 12, Deputy Prime Minister Tran Hong Ha chaired an online meeting with 25 provinces and cities to listen to reports and comments on the draft Decree detailing the implementation of a number of articles and measures to implement the Law on Geology and Minerals.

The Law on Geology and Minerals takes effect from July 1, 2025, however, some points of the law will take effect from January 15, 2025. At the meeting, a report on the draft Decree of the Government detailing a number of articles and measures to implement the Law on Geology and Minerals was heard. Ministries, branches and localities had many comments on some additional points and explanations of the decree...

Speaking at the meeting, Chairman of An Giang Provincial People's Committee Ho Van Mung proposed to add to the draft Decree to clarify the Law on Geology and Minerals in 2024 and ensure feasibility. Specifically, the contents not yet specified in the draft decree, during the implementation process, An Giang province is facing difficulties, so that localities can implement it properly and avoid violations.

Accordingly, it is proposed to review Article 46 which is contrary to Article 57, and it is necessary to unify the authority and clearly define it to be within the authority of the Provincial People's Committee or the Chairman of the Provincial People's Committee. Clause 4, Article 66 of the Law on Geology and Minerals stipulates: "In case the mineral exploitation license expires but there are still mineral reserves and the organization or individual that previously had the exploitation license is not eligible for extension or re-issuance of the exploitation license, the granting of a mineral exploitation license to another organization or individual shall be implemented in accordance with the provisions of this law", but the draft Decree does not clearly state the granting of mineral exploitation licenses to other organizations or individuals, nor does it stipulate the form of granting designation, selection (for areas without auction) or auction of exploitation rights, so it is necessary to stipulate more clearly for local implementation. The Chairman of the Provincial People's Committee also highly agreed on decentralization and stronger delegation of power to localities in the management and use of mineral resources, promoting sustainable development of the mineral exploitation industry, effectively cutting down administrative procedures and the motto: "Locals do, localities are responsible".

Deputy Prime Minister Tran Hong Ha emphasized that this meeting aims to gather the intelligence and participation of ministries, branches and localities to ensure feasibility, reduce unclear issues and avoid confusion after promulgation.
