Functions, tasks and powers of the Civil Aviation Authority of Vietnam

The Ministry of Transport (MOT) has just issued Decision No. 651/QD-BGTVT on regulating the functions, tasks, powers and organizational structure of the Civil Aviation Authority of Vietnam (CAAV).

According to this Decision, the Civil Aviation Authority of Vietnam is an organization under the Ministry of Transport , performing the function of advising the Minister of Transport on state management of civil aviation nationwide; directly performing the tasks and powers of the Aviation Authority according to the provisions of law and international treaties to which the Socialist Republic of Vietnam is a member.

The Civil Aviation Authority of Vietnam has legal status, a seal with the national emblem; its own account at the State Treasury, its headquarters in Hanoi city; and its international transaction name is "Civil Aviation Authority of Vietnam".

The Civil Aviation Authority of Vietnam performs the duties and powers of the Aviation Authority as prescribed in Decree No. 66/2015/ND-CP dated August 12, 2015 of the Government regulating the Aviation Authority.

Some typical tasks and powers of the Civil Aviation Authority of Vietnam:

• Develop for the Minister to submit to competent authorities for promulgation or promulgate under his authority legal documents, strategies, planning, medium-term and annual plans; national programs, projects, development projects, mechanisms and policies on civil aviation.

• Develop national standards, national technical regulations and economic-technical norms for civil aviation to be submitted to the Minister for promulgation under his authority or request competent authorities to appraise and promulgate; organize the development and promulgation of basic standards for civil aviation.

• Organize the implementation of legal documents, strategies, programs, planning, plans, standards, technical regulations, and economic-technical norms specialized in civil aviation after they are approved and promulgated by competent authorities.

• Check, review, and systematize legal documents related to the civil aviation industry, propose solutions to handle conflicting, overlapping, illegal, or no longer appropriate legal documents, and control administrative procedures in the civil aviation sector according to the provisions of law; monitor the implementation of the law in the civil aviation sector.

• Organize propaganda and dissemination of laws on civil aviation; issue documents and handbooks on ensuring aviation security and safety, exploiting airports, ensuring flight operations, air transport, etc.

This Decision takes effect from the date of signing and replaces Decision No. 2606/QD-BGTVT dated September 7, 2017; Decision No. 1055/QD-BGTVT dated May 31, 2019; Decision No. 1824/QD-BGTVT dated September 23, 2020 of the Minister of Transport regarding the regulations on functions, tasks, powers and organizational structure of the Civil Aviation Authority of Vietnam.

In case the legal documents referred to in this Decision are amended, supplemented or replaced by other legal documents, the provisions of such amended, supplemented or replaced documents shall apply./.
