To answer the question of whether an apartment without a pink book can be registered for permanent residence or not? First of all, you must find out when you will be granted a pink book when you buy an apartment. To determine the time to be granted a pink book after buying an apartment, you need to determine whether the apartment being bought and sold is an old apartment or a new apartment.

When buying and selling old apartments, after notarizing the apartment sale and purchase contract, the buyer must submit documents to transfer the apartment's pink book to their name.

Unlike when buying an old apartment, if buying a new apartment, the investor is obliged to complete the procedure to request the State agency to issue a pink book to the buyer within 50 days from the date of handover or from the time the buyer fully pays the house price.

At the same time, according to Clause 6, Article 22 of Decree 101/2024/ND-CP, the time limit for issuing the pink book to the investor is no more than 10 days from the date of receiving a complete and consistent dossier. Thus, after paying in full or receiving the house, the maximum time for the new apartment buyer to receive the pink book is 60 working days.

Conditions for permanent residence registration are currently implemented according to the provisions of Article 20 of the 2020 Law on Residence, including: Having legal accommodation owned by oneself or having the consent of the head of household and the owner of legal accommodation (if there is no house owned by oneself).

According to Article 5 of Decree 62/2021/ND-CP, documents proving legal residence include:

- Certificate of land use rights, house ownership (including information about the house) or certificate of apartment ownership.

- Contract for sale of housing or documents of handover or receipt of housing from a business with the function of trading in housing for sale.

- Documents on purchase, hire-purchase, gift, inheritance...

Therefore, according to this regulation, it is not required to have a pink apartment book to be eligible to register for permanent residence, but it is possible to use a sales contract or handover document (if buying a new apartment with the investor) or a sales contract with another individual (if buying an old apartment).

Thus, an apartment that does not have a pink book can still be registered for permanent residence if it is a house owned by that person or with the consent of the homeowner and owner if the apartment is not owned by that person.
