Organizational structure and staffing of commune-level officials and civil servants after the rearrangement

The project to rearrange and reorganize administrative units at all levels and build a two-level local government model that has just been approved by the Government has many new points that specifically stipulate the rearrangement and reorganization of current commune-level administrative units.

The commune-level administrative unit after the rearrangement must ensure effective management of the area, grasp the situation, be close to the people, and serve the people best. In case of rearranging wards with administrative units of the same level, the new administrative unit after the rearrangement is the ward; in case of rearranging communes and towns, the new administrative unit after the rearrangement is the commune.

It is not mandatory to reorganize communes that are isolated and have difficulty organizing traffic connections with adjacent administrative units or have particularly important locations that affect national defense, security and the protection of national sovereignty . The total number of communes after reorganization is reduced to 60-70%, ensuring a reasonable correlation, avoiding creating large gaps and differences in natural area and population size.

The organization of two-level local government is implemented as follows: At the provincial level, there are People's Councils and People's Committees; The provincial People's Council establishes three committees: the Legal Committee, the Economic - Budget Committee, and the Cultural - Social Committee (provinces with many ethnic minorities can add an Ethnic Committee).

The People's Council of a centrally-run city establishes four committees (Legal Committee, Economic - Budget Committee, Cultural - Social Committee and Urban Committee) according to the provisions of the Law on Organization of Local Government 2025.

The number of cadres, civil servants and public employees at the provincial level after the rearrangement must not exceed the total number before the rearrangement. Then, streamlining must be carried out in conjunction with restructuring and improving the quality of the cadres, civil servants and public employees. Ensuring that within 5 years, the arrangement is basically in accordance with regulations. After the rearrangement, the construction and completion of job positions must be submitted to the competent authority to assign the payroll to the localities.

Regarding the arrangement of provincial leadership and management teams, the current number will be maintained until operations are stable. After that, we will continue to review and finalize job positions and determine staffing levels.

Regarding the organization of local government at the commune level (commune, ward, special zone), it will include the People's Council and the People's Committee. In which, the People's Council at the commune level establishes two Committees: the Legal Committee and the Economic - Social Committee.

Accordingly, all tasks and powers of the current district-level local government will be transferred to communes, wards, and special zones for implementation. Commune-level People's Committees will organize a maximum of four specialized departments and equivalents suitable to the characteristics of urban, rural, and island areas (special zones).

For commune level, the status quo may not be maintained, and it is expected that there will be an additional vice chairman and a number of civil servants. The local government at the provincial level will decide on a case-by-case basis.

In the case of reorganizing two or more commune-level administrative units into a new commune, a maximum of four specialized departments and equivalents will be organized under the People's Committee at the commune level, including: Office of the People's Council and People's Committee; Economic Department (for communes and special zones) or Economic, Infrastructure and Urban Department (for wards and special zones in Phu Quoc); Department of Culture - Society; Public Administration Service Center.

Due to the increase in the size of commune-level administrative units, the Government plans to keep the number of commune-level cadres, civil servants and public employees unchanged for the time being. After that, it will review and streamline the number of staff, along with restructuring and improving the quality of the team, ensuring that within a period of 5 years, it will basically comply with regulations.

The Ministry of Home Affairs shall coordinate with the Central Organizing Committee and relevant agencies to base on population size, natural area, functions, tasks, and powers to develop and complete job positions and submit them to competent authorities to assign the establishment of commune-level cadres, civil servants, and public employees to localities.

Accordingly, the Government has directed that the total number of staff at the commune level is expected to average about 32 staff/commune level and assigned to the provincial level for decision.

End of use of non-professional workers

The project also clearly states that the use of part-time workers at the commune level will be ended; local authorities will be assigned to consider and possibly arrange part-time workers at the commune level who meet the requirements of the task to participate in work in villages and residential groups; and a leave policy will be implemented for part-time workers at the commune level who are not assigned work according to regulations.
