On June 3, Mr. Phan Dinh Mai, residing in Tan Thuan Tay Ward, District 7 (HCMC), on behalf of a group of customers buying houses at the Aloha Beach Village project (Thuan Quy Commune, Ham Thuan Nam District, Binh Thuan ), continued to send a petition to the authorities of Binh Thuan, accusing the investor of this project of taking advantage of trust and defrauding home buyers.
Mr. Phan Dinh Mai said that representatives of the Binh Thuan Provincial Police (PC03 Department) invited a number of home buyers to the headquarters to give statements twice. "Following the direction of the Secretary of the Binh Thuan Provincial Party Committee, the Binh Thuan Provincial Party Committee's Internal Affairs Committee also sent a written response to the households and asked us to file a lawsuit to claim the house and money," Mr. Mai said.
A group of customers from Ho Chi Minh City came to the Aloha project and hung banners, calling out the investor's name to demand their houses, threatening public order and security.
According to Mr. Phan Dinh Mai, although the Aloha Beach Village project has not been completed in terms of construction and does not have full legal documents, the investor, Mr. Tu Van Phuoc, has required home buyers to sign the "house handover minutes".
Next, the customers continue to sign an "apartment rental" contract between one party being the home buyer and the other party being the project owner, who is also the lessee of the house, with the profit divided as follows: the lessor gets 75%, the lessee gets 25%.
The house has not been handed over yet but the investor has collected 2% of the house maintenance fee.
"Immediately after that, the investor made a document asking us to pay 2% of the house maintenance fund, even though we didn't know what the house looked like. While we had already paid 95% of the house's value to the investor in 2017," said Mr. Mai.
According to Mr. Mai, his group has about 54 people, all residing in Ho Chi Minh City, many of whom know the investor (Mr. Tu Van Phuoc) so they trust him and borrow money from the bank to buy a house. The person with the least amount of money has given the investor 1 billion VND, the person with the most money has given nearly 2 billion VND, but from 2017 until now, they have not received the house, while paying interest to the bank for the past 5 years.
Mr. Mai said that this project has about 370 houses (apartments) and has sold about 156 units, so with an average of only 1 billion VND/unit, the investor has collected hundreds of billions of VND from buyers over the past 5 years but has not yet delivered the houses to customers.
The investor confirmed that customer Phan Dinh Mai has paid 95% of the house value after deducting the discount from January 2018 until now but has not yet received the house.
At the citizen reception form dated May 31, 2023 of the Citizen Reception Committee (under the People's Committee of Binh Thuan province), the citizen reception officer of the People's Committee of Binh Thuan province said that the People's Committee of this province has recently received petitions related to the Aloha Beach Village project (the investor is Viet Uc Investment - Trade - Service Joint Stock Company).
The Office of the People's Committee of Binh Thuan province has also instructed these citizens to file a lawsuit in court to protect their legitimate rights. At the same time, according to the citizen reception form, the People's Committee of Binh Thuan province has also issued a document directing relevant departments to review and handle the matter according to their responsibilities.
The Aloha Beach Village project is advertised by the investor as "The first Hawaiian City in Vietnam" with the promise of handing over houses in 2017, but to date it still lacks legal documents.
Responding to Thanh Nien reporters, a leader of the People's Committee of Binh Thuan province said that immediately after Thanh Nien Newspaper published the article "Customers from Ho Chi Minh City came to Binh Thuan to hang banners demanding their houses", the Standing Committee of the Provincial Party Committee urgently directed to request a report on the incident.
Currently, the Department of Construction, the Department of Planning and Investment and the Department of Natural Resources and Environment of Binh Thuan are preparing to report to the Provincial People's Committee and the Standing Committee of the Provincial Party Committee before June 5 about the incident mentioned in the newspaper.
