Prosecutor says Trump left classified documents 'indiscriminately' in his residence

The Guardian reported on June 25 that during the hearing on the classified documents that took place on June 24-25, Mr. Trump's lawyer requested to dismiss the case because the order of the documents in the boxes had changed. The prosecution admitted that some documents were no longer in their original order after being seized by the government , but rejected the request to dismiss the case.

Special prosecutor Jack Smith filed a 33-page report defending the FBI’s August 2022 search of Trump’s Mar-a-Lago resort in Florida, where it seized more than 100 classified documents. The search prompted a criminal prosecution of Donald Trump on charges of mishandling classified documents.

The prosecution also provided images of the process of seizing the documents on June 24. Accordingly, the confidential documents were allegedly "stored haphazardly", when stacked with personal items, including clothes, books, newspapers, pictures, and Christmas decorations.

“Mr. Trump personally chose to keep documents containing some of the nation’s most closely guarded secrets in cardboard boxes along with a collection of mementos of his presidency, which came in various sizes and shapes. Additionally, because the boxes were stacked in tiers in the warehouse, some of the boxes fell and documents were scattered across the floor,” according to the prosecutor’s report.

Given the state in which the classified documents were stored, prosecutors argued that it would not be a problem if some of the documents were out of order when the FBI seized them. According to CNN, Trump’s legal team said that placing classified documents in order with other files was a way to build “layers of protection” for classified documents.

Trump’s lawyers argued that the FBI lacked a valid reason to search the entire Mar-a-Lago complex, which has many private bedrooms and bathrooms. Judge Aileen Cannon responded that classified documents were understood to be found in any area of the resort, according to Fox News.
