Specifically, the Food Safety Department has issued Official Dispatch No. 1030/ATTP-NDTT to the Dong Nai Provincial Department of Health requesting to inspect and verify advertising information related to Nestlé Milo products. This is done based on Article 40 of Decree 15/2018/ND-CP detailing the implementation of a number of articles of the Food Safety Law.

At the same time, the Department also sent Official Dispatch No. 1031/ATTP-NDTT to the National Institute of Nutrition, requesting an urgent review of product communication and advertising content to ensure compliance with Clause 2, Article 27 of Decree 15/2018/ND-CP and strictly implement Directive No. 17/CT-TTg dated May 9, 2017 of the Prime Minister on strengthening the effectiveness of state management in advertising activities.
Regarding this issue, the National Institute of Nutrition said that it had previously cooperated with Nestlé Vietnam Company to conduct a grassroots scientific research project entitled "The effectiveness of physical education combined with the use of Nestlé Milo barley milk supplement on the nutritional status, physical strength and mental strength of students at some primary schools in Ninh Binh province".
The study was conducted from June 2022 to March 2023 on 576 primary school students and was approved by the grassroots acceptance council.
Research results show that the combination of physical activities according to the curriculum and the use of Nestlé Milo barley milk products effectively improves physical factors of primary school students such as speed, strength, endurance, flexibility and dexterity.
In response to the feedback related to the use of research results in advertising activities, the Institute of Nutrition sent Document No. 368/VDD-TTGDTT to Nestlé Vietnam Company, requesting a review of all communication and advertising content.
The Institute emphasizes that if there is any information using the Institute's name or research results in violation of regulations, it must be removed immediately to ensure compliance with the law in advertising and disseminating nutritional knowledge.
In response, Nestlé Vietnam sent Document No. 23/2025/CV-NVL to the Institute of Nutrition, committing to "immediately review current advertising activities" and remind media partners to ensure compliance with legal regulations.
The Food Safety Department continues to monitor the case and recommends that organizations and individuals operating in the food sector strictly comply with current regulations on advertising to avoid misleading consumers and affecting the reputation of domestic scientific agencies and research facilities.
