Traffic Police Department explains a series of questions related to car license plate auctions

Vietnamese citizens across the country can participate in car license plate auctions. There is no limit to the number of auctions or the number of vehicles auctioned. As long as the people register for the auction in accordance with the auction regulations of the law, specifically stipulated in Resolution 73 and Decree 39 of the Government .

From July 1, 2023, Resolution No. 73/202/QH15 on pilot auction of car license plates of the National Assembly officially takes effect. People will have the right to choose and compete to own the car license plates they want. To better understand these regulations, VOV Online Newspaper reporter will have an interview with Major General Le Xuan Duc - Deputy Director of the Traffic Police Department, Ministry of Public Security .

Reporter: From July 1, 2023, the National Assembly 's Resolution on piloting the auction of automobile license plates will officially take effect. Could you tell us how far the preparations for infrastructure, human resources and number warehouses for the auction have been made? Will people be able to start participating in the auction from the beginning of July?

Major General Le Xuan Duc : First of all, let's look back at the 30-year journey of car license plate auctions. Implementing the direction of the Ministry of Public Security's leadership, taking people as the center, resource, and driving force in ensuring traffic order and safety, July 1 is the effective date of Resolution 73/2022/QH15 on pilot car license plate auctions, which is also the effective date of Decree No. 39 of the Government on guiding the implementation of Resolution 73.

We note the following three milestones: In 1993, the Ministry of Public Security directed Hai Phong City Police to pilot the granting of the right to choose car license plates and collect fees.

By 2008, the police of some localities such as Ba Ria Vung Tau, Nghe An, Binh Duong, Son La... reported to the Ministry of Public Security, proposing that the Government allow the selection of the method of auctioning car license plates. However, after many seminars and asking for opinions from the Prime Minister and ministries, there were still legal problems, and public opinion was divided.

Therefore, in 2011, the Ministry of Finance reported to the Prime Minister to allow the suspension of the research on the pilot auction of car license plates. The second milestone was in 2017, when the Government Office issued a notice from the Prime Minister assigning the Ministry of Public Security to preside over and coordinate with relevant ministries and branches to research the project on auctioning car license plates.

After 5 years of implementation, the Ministry of Public Security has coordinated with the Government Office, the Ministry of Justice, the Ministry of Finance, etc. to research and develop a pilot project to grant the right to choose to auction car license plates.

However, after 5 years, with many seminars and consultations with ministries and branches, it is found that there are still many legal problems. The provisions of the law are not suitable and difficult to implement. For example, the law on public property, the law on property auction...

Therefore, we need a Government resolution that is different from the current law, to create a legal corridor for us to implement the auction of car license plates.

The third milestone was at 2:25 p.m. on November 15, 2022, at the 4th session of the 15th National Assembly, the draft Resolution on auctioning car license plates was passed with 94.98% of the votes. And after 30 years, we have reached the finish line.

Up to this point, we have completed the legal aspect. At the same time, we have prepared human resources; built a plan to implement 2 resolutions; and built an information technology infrastructure platform.

In addition, the Ministry of Public Security will select an auction organization to conduct public and transparent auctions.

We also offer a pool of numbers for people to choose from. The first auction is scheduled to take place from August 15 to August 20.

Reporter: How will the auction be conducted, sir? What steps do people participating in the auction need to take before, during and after the auction? Can you elaborate on how the Resolution stipulates the rights and obligations of the auction winner of the car license plate; the transferee, exchanger, recipient, or inheritor of the car with the auctioned license plate? How many license plates can one person participate in the auction?

Major General Le Xuan Duc: According to the provisions of Resolution 73, the Ministry of Public Security selects an auction company independent of state management agencies, and conducts online auctions.

Thus, all people everywhere can access the auction page of the auction company, perform the procedural steps according to the video instructions we just sent to our audience. I affirm one thing that all the interests of the people according to the provisions of the law are met by the law, served by legal agencies.

Resolution 73 has met the needs of the people, which is the right to use the license plate that won the auction. The people who won the auction have the right to buy, sell, transfer, and inherit the license plate. But it is important to understand that for a vehicle to be on the road, it must be registered and inspected for safety to be eligible for road use.

A license plate that stands alone will have no value. Therefore, the auction winner must register according to the vehicle registration regulations when exercising the right. Second, the registration period. Third, the license plate must be attached to the vehicle to ensure all rights specifically stipulated in the Resolution.

We see that the law is very open, not restricting the rights of the people. People can participate in auctions in all provinces across the country, without limiting the number of auctions, without limiting the number of auction vehicles. As long as the people's auction registration complies with the auction regulations of the law, specifically stipulated in Resolution 73 and Decree 39 of the Government.

Reporter: People are very interested in starting prices, deposits, price steps, and money collected from car license plate auctions. How can you inform people about this issue, sir?

Major General Le Xuan Duc: There are two issues that we need to manage: human management and vehicle management. Regarding human management, the Ministry of Public Security has a project on citizen identification. Vehicle management will include vehicle license plate identification.

Regarding the starting price of 40 million VND, this is the price equal to 5% of the most popular cars that people are currently driving. This is a starting price that is very suitable for the current economic conditions of people.

Regarding the deposit price, according to the Resolution, it will be equal to the starting price. The minimum bid step is 5 million VND and the bidder can place bid steps of 5 million VND x n (n is unlimited).

The auction method is an ascending auction and the entire auction amount will be paid into the state budget. When allocating the budget, the Ministry of Finance will report to the Government and the Government will submit to the National Assembly to disburse this budget source.

Reporter: In cases where the license plate is not the winning number at auction, but when selling the car, the license plate is intentionally not returned but kept for transfer, do we have any management methods to prevent this situation, sir?

Major General Le Xuan Duc: We have specific regulations for this case. For example, Decree 100 clearly states that vehicle owners who do not complete the procedures for transferring ownership after buying or selling a vehicle will be penalized. Regulations on the vehicle owner's responsibility for all vehicle activities when participating in traffic.

With the above two regulations, gradually with people's awareness of the rule of law, the management of vehicle owners will be strict.

PV: Could you please tell us how license plate identification will be understood and what benefits will this bring to the people and management agencies when applied?

Major General Le Xuan Duc: When we conduct license plate auctions online, cyber attacks that paralyze the auction process or distort auction results are potential risks, and the Ministry of Public Security has taken into account and prepared carefully to ensure network security. During the auction process, we ensure publicity, transparency and safety.

License plate identification is a fairly new phrase. Here we only change the way of management. Car license plate identification is understood that when people buy, sell, or transfer the name of a vehicle, the license plate of the people will still be retained and continue to be registered for another vehicle.

The number on the license plate will be like a phone sim, which can be installed on any device. So it can be understood that when the vehicle owner sells his vehicle, he can keep the license plate to register another vehicle.

Doing so can be good for state management, especially handling administrative violations.

Currently, when sending violation notices to vehicle owners, the vehicle owners have already sold them to others, so it is difficult to have regulations to request vehicle owners and violators to implement penalty decisions.

Or when an accident occurs, it will be very difficult to determine the responsibility of the vehicle owner and the responsibility of the driver who caused the accident.

Thus, moving towards identifying car license plates is to better serve the state's management work and ensure the rights and obligations of people in participating in traffic when using vehicles.

PV: According to the license plate identification regulations, how many license plates can each person own, sir ?

Major General Le Xuan Duc: This is an issue that people are very concerned about and has been specifically regulated in Directive No. 10 of the Prime Minister on strengthening traffic safety and order in the new situation.

In which the Ministry of Public Security is assigned to develop a project on car license plate identification to serve state management work.

When building this project, the nature of the problem is to serve the state management of ensuring traffic safety and order, in order to manage well to ensure traffic safety and order.

There are 5 factors that make up this project: First is the current traffic infrastructure planning. If the density of vehicles increases as it is now from 10-15% annually, apartments are built while the roads can only meet a certain level, then surely one day in Hanoi, Ho Chi Minh City and other big cities will be crowded with cars and motorbikes.

Second, we need to improve public transportation so that people feel comfortable using public transportation, and find it better than driving their own vehicles. Third, people need to be aware of the rule of law when participating in traffic.

Fourth, to limit traffic, it is necessary to increase the fee for personal vehicles entering the inner city.

Finally, the identification of car license plates. At a certain point, each citizen will have the right to register a certain number of vehicles. When exceeding that certain number, a fee must be paid to limit the increase of personal vehicles, reducing congestion in urban areas. Identification of license plates is one of the measures included in the overall project.

PV: What about the license plate warehouse, sir? In the first round of the auction, how many license plates are expected to be offered and from which localities?

Major General Le Xuan Duc: In Resolution 73, we will organize auctions for all license plates of 63 localities, so that people have the right to choose license plates of all localities. For example, people in Ho Chi Minh City, if they like, can still choose and auction license plates in Hanoi.

According to the plan of the Traffic Police Department, within a quarter, we will issue about 100,000 license plates for auction. And this number of plates will be an auction, in the auction there will be many auctions; we will not auction 100,000 license plates at once, but depending on the actual situation, the needs of the people... we can auction 1,000 plates, 10,000 plates...

Vietnamese citizens from all over the country can participate in the auction. When people come to register for the license plate auction, they only need to bring their ID card and register at their permanent or temporary residence. This is a very open policy of the Ministry of Public Security, focusing on the people.
