With many new points in Decree 166 taking effect from January 1, a representative of the Vietnam Register warned that from January 2, when inspection facilities resume operations after the New Year holiday, many vehicles may be refused inspection.
Specifically, the new regulations in Decree 166/2024 and Circular 47, effective from January 1, 2025, clearly state the procedures for inspection and exemption from first-time inspection for motor vehicles and specialized motorbikes; the procedures for registration of modified motor vehicles and specialized motorbikes; and the procedures for inspection of exhaust emissions of motorbikes and mopeds.
With the new contents, the Vietnam Register warns of some noteworthy issues. Specifically, the registration facility will refuse to inspect vehicles: Administrative violations in the field of road traffic order and safety; at the request of the prosecuting agencies; there is evidence that the vehicle owner has falsified vehicle documents; there is a discrepancy between the vehicle registration certificate and the actual vehicle when carrying out the inspection procedure; the vehicle registration certificate has not been reissued at the next inspection after the vehicle has been granted a certificate of renovation.
The representative of the Vietnam Road Administration is concerned: “With the above regulation, a series of vehicles will be refused inspection, for the following reasons: The vehicle owner has not fulfilled the responsibility to resolve administrative violations in the field of road traffic order and safety; the vehicle has been renovated but the vehicle owner has not completed the procedure to change the vehicle registration certificate; the vehicle has been converted to the transportation business type (yellow license plate) but the vehicle owner has not completed the procedure to change the vehicle registration certificate or vice versa; the paint color on the vehicle registration certificate is not the same as the actual color of the vehicle; the vehicle owner arbitrarily changes or remodels the vehicle, resulting in the vehicle's technical specifications being different from the vehicle registration certificate.”
Explaining the above situation, a representative of the Vietnam Register said that the cause was due to the fact that for a long time, vehicle owners did not comply with legal regulations.
Therefore, this regulation is issued so that vehicle inspection agencies and vehicle owners must comply with it, ensuring the rule of law and unifying vehicle data between vehicle registration agencies and inspection agencies, creating favorable conditions for vehicle management and handling of violations.
Unblocking modified vehicles
To remove difficulties, resolve existing problems, obstacles, and shortcomings in the past and create favorable conditions for people and businesses to be able to carry out procedures to re-issue vehicle registration certificates, Circular No. 47 stipulates that the certification of modified vehicles and re-issuance of modified vehicle certificates are carried out at all motor vehicle inspection facilities nationwide.
It clearly stipulates a number of cases: Motor vehicles with information that is different from the vehicle registration certificate, but have not been granted a certificate of renovation, must carry out the procedures for certification of renovation according to regulations.
In cases where a vehicle has been modified but has not undergone the procedure to change the vehicle registration certificate, and the modified certificate is lost or expired or incorrectly issued, the vehicle owner will be reissued a modified vehicle certificate to carry out the reissuance of the vehicle registration certificate.
“For other cases of vehicle inspection refusal, vehicle owners must proactively contact competent authorities such as vehicle registration agencies, agencies handling administrative violations in the field of road traffic order and safety, and prosecution agencies (Police, Procuracy, Court) for resolution,” a representative of the Vietnam Register recommended.
