The provincial National Assembly delegation led by comrade Vu Dai Thang, member of the Party Central Committee, Secretary of the Provincial Party Committee, participated in the discussion of the draft resolution of the National Assembly on the Law and Ordinance Development Program (LDP) in 2025, adjusting the LDP and Ordinance Development Program in 2024.

Basically agreeing with the content of the submission of the National Assembly Standing Committee (NASC) on the proposed Law and Legal Development Program for 2025 and adjustments to the Law and Legal Development Program for 2024, comrade Nguyen Minh Tam, Provincial Party Committee member, Deputy Head of the Provincial National Assembly Delegation, affirmed that the legislative work has been accelerated, with strong progress, and in a short period of time, the draft laws have been examined relatively thoroughly.

However, in response to concerns raised by many National Assembly deputies regarding the drafting process in recent times, many drafting agencies have failed to ensure the process despite having a program and plan in place, resulting in the deputies not being able to thoroughly study some laws, many of which are very difficult and require expert consultation.

Therefore, to complete the 2025 Law and Legal Program and adjust the 2024 Law and Legal Program, comrade Nguyen Minh Tam suggested that the Government continue to direct the development of an implementation plan and focus on widely publicizing the draft law, soliciting opinions from voters and people, especially those affected. It is necessary to overcome the practice of soliciting opinions before drafting the draft, but when the draft is completed, there is no comparison or review with these subjects again.

To meet the practical requirements of life, he also proposed to add to the 2025 Law and Order Program the content of amending and adjusting 2 ordinances, including: Ordinance regulating the State honorary title "Heroic Vietnamese Mother" approved by the Standing Committee of the National Assembly in 1994, amended and supplemented by Ordinance No. 05/2012 dated October 20, 2012 and Ordinance on preferential treatment for people with revolutionary contributions No. 02/2020 approved by the Standing Committee of the 14th National Assembly on December 9, 2020.

He analyzed the case of Ms. Phan Thi Hanh, mother of martyr Le Duc Hai in Quang Binh , who grew up suffering the pain of losing her father at a young age (her father was a martyr who died in the resistance war against the US to save the country). After a childhood without a father, growing up during a fierce and difficult war, she grew up, got married and had 2 children, including an only son who died while performing a rescue mission to help people overcome the consequences of storms and floods in October 2020 in Huong Hoa district, Quang Tri province, and was awarded the title of martyr. However, according to the provisions of Article 2 of the Ordinance stipulating the State honorary title "Heroic Vietnamese Mother" (The regulation states: Having 2 or more children who are martyrs; (2)- Having only 2 children, 1 of whom is a martyr and 1 of whom is a war invalid with a working capacity reduction of 81% or more; (3)- Having only 1 child, that child is a martyr; (4)- Having 1 child who is a martyr and having a husband or herself being a martyr;...), she is not eligible to be awarded the title "Heroic Vietnamese Mother".

According to the delegate, this is just one of many mothers who are children of meritorious families, and later continue to have children who are martyrs in peacetime, including martyrs who are doctors who sacrificed their lives during the Covid-19 pandemic. If following the provisions of Article 2 of the Ordinance, mothers whose children sacrificed their lives in peacetime are very unlikely to be eligible to be awarded or posthumously awarded this honorable title. The opinion also emphasized that with the current population policy regulations of the Party and State, each family only has 1 to 2 children, having a child who is a martyr is an irreparable pain, deserving of gratitude and honor.

He also suggested that it is necessary to expand the adjustment for mothers whose children are martyrs and who have made many contributions to the cause of building and defending the country in peacetime. Amending the Ordinance regulating the State honorary title "Heroic Vietnamese Mother" is to promptly express gratitude and comfort the souls of deceased martyrs and mothers whose children are martyrs and have made many contributions in the period of industrialization and modernization to suit the current situation. The opinion suggested reviewing, amending and supplementing the Ordinance in the direction of adjusting and supplementing the criteria to expand the subjects eligible for conferring or posthumously conferring the State honorary title "Heroic Vietnamese Mother".

The Ordinance on preferential treatment for people with revolutionary contributions approved by the Standing Committee of the 14th National Assembly on December 9, 2020 (specifically stipulated in Decree No. 131/2021/ND-CP, dated December 30, 2021) is also a special policy of the Party and State to show gratitude and honor people with revolutionary contributions.

However, in the process of receiving and handling petitions, complaints and denunciations from the people, there were many reflections: During the fierce war, many people sacrificed their lives while performing their duties, but compared with the current regulations of the Ordinance on preferential treatment for people with revolutionary contributions and related legal documents, they are not among the subjects recognized as martyrs.

Considering that currently, the number of relatives of those who sacrificed in this category is not much, but in order to promptly acknowledge and express gratitude to those who sacrificed and comfort the families whose relatives died in the resistance war against the US to save the country, the comrade proposed to consider, amend and supplement point b, clause 1, Article 14, Ordinance on preferential treatment for people who contributed to the revolution on the conditions and criteria for recognizing martyrs as follows: "People who sacrificed while performing tasks assigned by the organization to serve in combat in enemy-occupied areas, war zones, and areas adjacent to enemy-occupied areas from April 30, 1975 onwards".
