Sending a question to the Government Electronic Information Portal, Mr. Tran Hai Huong ( Quang Tri ) said that his family has a piece of land reclaimed since about 1980, currently used to grow perennial crops and fruit trees.
There are currently households living around the land, and the households have Land Use Rights Certificates. Mr. Huong asked, if he wants to register the land use rights on this land to build a house, is that possible? If so, what documents and procedures do he need to prepare?
The Ministry of Agriculture and Environment responded to this issue as follows:
The content of your reflection is unclear in procedures, lacking in information and documents, therefore, the Ministry of Agriculture and Environment has no basis to respond specifically. The Ministry of Agriculture and Environment informs some contents for you to study and refer to in the process of implementing administrative procedures on land as follows:
Current land laws in effect: Land Law 2024 and guiding documents, detailed regulations for implementation (Decree No. 101/2024/ND-CP, Decree No. 102/2024/ND-CP, Decree No. 151/2025/ND-CP...).
For the first issuance of a Certificate to a household or individual using land without documents on land use rights as prescribed in Article 137 of the Land Law, without violating the land law as prescribed in Article 139 of the Land Law, and not falling under the case of land allocation without proper authority as prescribed in Article 140 of the Land Law, it shall be implemented according to the provisions of Article 138 of the Land Law.
The Ministry of Agriculture and Environment recommends that you study the above regulations and contact the local authorities for resolution.
