Deputy Prime Minister Tran Hong Ha signed Decision No. 1462/QD-TTg dated November 25, 2024 on the investment policy for the project to invest in construction and business of infrastructure of Hoa Yen Industrial Park, Bac Giang Province (Project).
Specifically, the Deputy Prime Minister approved the investment policy; at the same time approved the project investor, Fecon Hoa Yen Joint Stock Company.
The project has a scale of 256.68 hectares with an investment of 3,745,131 billion VND (of which the investor's capital contribution is 561,778 billion VND).
The project is implemented in Dong Lo commune, Hiep Hoa district and Tien Son, Trung Son, Huong Mai communes, Viet Yen town, Bac Giang province.
The project's operating period is 50 years from the date of investment policy approval.
The Deputy Prime Minister requested the Ministry of Planning and Investment to take responsibility for the assigned contents of project investment policy appraisal and to perform state management of industrial parks in accordance with the provisions of the law on investment and relevant laws.
Relevant ministries and branches are responsible for the content of project investment policy appraisal within their functions and tasks according to the provisions of the law on investment and relevant laws.
Check and supervise the implementation of investor commitments
The People's Committee of Bac Giang province is responsible for the truthfulness and accuracy of information, reported data and appraisal contents according to the provisions of law; accepts the opinions of the Ministries in the dossier approving the project investment policy for the contents within its authority; guides, manages and supervises to ensure that investors comply with the provisions of law and implement the contents and conditions during the project implementation process.
Ensure that the project is allocated enough industrial park land to implement according to the approved schedule; at the same time, it is included in the land allocation and zoning plan in the Bac Giang provincial planning and the annual land use plan of Hiep Hoa district, Viet Yen town approved by competent authorities according to the provisions of the law on land, ensuring the socio-economic and environmental efficiency of industrial park infrastructure projects, avoiding spreading out the allocation of targets.
Organize and implement the tasks of compensation, site clearance and compensation, support and resettlement plans when the State reclaims land in accordance with the provisions of law; carry out land reclamation in accordance with the project implementation progress; ensure the legitimate rights and consensus of organizations, individuals and subjects whose land is reclaimed; note that housing for resettlement must have a complete technical and social infrastructure system and ensure the requirements for housing development in accordance with the provisions of the law on housing.
Check and determine the investor's ability to meet the conditions for land lease and permission to change land use purposes according to the provisions of the law on investment, the law on land and the law on real estate business at the time the investor is allocated land or leased land to implement the project; supervise investors in borrowing credit from credit institutions and issuing corporate bonds to implement the project according to the provisions of the law on real estate; inspect and supervise the implementation of investors' commitments to ensure conditions for investment in industrial park infrastructure according to the provisions of Clause 4, Article 9 of Decree No. 35/2022/ND-CP; In case of failure to fulfill the commitment, appropriate procedures shall be carried out in accordance with the provisions of the law on investment and relevant laws on land recovery in case the investor is not capable, causing delays in progress in order to effectively use industrial park land to create a healthy investment environment in Resolution No. 499/NQ-UBTVQH15 dated March 18, 2022 of the Standing Committee of the National Assembly.
Monitor investors' compliance with environmental laws during project implementation; prioritize attracting investment projects with modern, environmentally friendly technology that use little labor and resources; ensure a safe distance between the industrial park and surrounding areas, and develop monitoring plans to monitor waste discharge activities in the industrial park.
The investor must ensure sufficient equity as committed.
Fecon Hoa Yen Joint Stock Company is responsible before the law for the legality, accuracy and honesty of the contents of the project dossier and documents sent to competent state agencies; accepts the opinions of the Ministries and the People's Committee of Bac Giang province in the dossier approving the project investment policy; bears all risks, costs and takes full responsibility according to the provisions of Article 47 and Article 48 of the Investment Law in case of violating the provisions of the law on investment and the provisions of the law on land.
Fully implement environmental procedures, including environmental impact assessment according to regulations of law on environmental protection; comply with regulations of law on irrigation and law on water resources during project implementation; report to competent state agencies if discovering minerals with higher value than minerals used as common construction materials for handling according to regulations of law on minerals.
Ensure sufficient equity capital as committed to implement the project on schedule; ensure to meet the conditions specified in Point c, Clause 2, Article 9 of the Law on Real Estate Business; specify the loan plan by credit contract; deposit or have a bank guarantee on the deposit obligation to implement the project; borrowing credit from a credit institution, issuing corporate bonds (if necessary) to implement the project must meet the conditions specified by the law on real estate business.
Carry out investment in the construction of infrastructure systems according to the construction planning of Hoa Yen Industrial Park approved by competent authorities; arrange land funds for enterprises and subjects entitled to land lease incentives to ensure compliance with the provisions of Clause 4, Article 9 of Decree No. 35/2022/ND-CP dated May 28, 2022 of the Government regulating the management of industrial parks and economic zones.
