Request to clarify the reason why the Minister 'receives few citizens, delegates many powers'

Continuing the 27th Session, on the afternoon of October 11, the National Assembly Standing Committee reviewed the Government's report on citizen reception and complaint and denunciation settlement in 2023.

 

Do not let "hot spots" of security and order occur

 

Presenting the Government's report, Government Inspector General Doan Hong Phong said that in 2023, the number of citizens coming to state agencies to make complaints, denunciations, and recommendations increased compared to 2022.

 

The number of people coming to state administrative agencies to make complaints, denunciations, recommendations, and reflections increased by 37.5% compared to 2022, with the total number of people received increasing by 41.8% in more than 294,000 cases (an increase of 33.2%). People's courts at all levels received 285 people in 253 cases (without large groups), including: 170 complaints; 83 denunciations.

Regarding the results of receiving and handling complaints and denunciations, administrative agencies received 446,805 petitions of all kinds; processed 422,801 petitions. Compared to 2022, the number of petitions of all kinds increased by 29.6%, complaints increased by 20.5%, and denunciations increased by 23.5%.

 

According to Mr. Doan Hong Phong, the Government Inspectorate and ministries, branches and localities conducted 1,531 inspections and examinations of responsibilities (an increase of 20.7%) in implementing the law on complaints and denunciations; issued 1,283 inspection conclusions. Through inspections, administrative sanctions were recommended for 233 organizations and 520 individuals; 190 organizations and 460 individuals were sanctioned.

 

In the coming time, the Government, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit will continue to identify citizen reception and complaint and denunciation settlement as key tasks.

 

Agencies focus on performing well the work of receiving citizens, being proactive, grasping the situation, promptly handling and resolving complaints and denunciations as soon as they arise, not allowing "hot spots" to occur that cause complications in political security and social order.

 

Clarifying the reason for "receiving less, delegating more"

 

The Government's Report shows that the work of receiving citizens and handling complaints and denunciations in 2023 continues to be innovative, achieving positive results, promptly resolving in accordance with the law 81.8% of complaints and 86.2% of denunciations under its jurisdiction.

 

Chairman of the National Assembly's Law Committee Hoang Thanh Tung, representative of the inspection agency, said that the Standing Committee of the Committee highly appreciated the efforts, determination and achievements in this work of the Government, ministries, branches, localities, People's Courts, People's Procuracies at all levels and the State Audit, thereby contributing to maintaining political stability, social order and safety, especially in the context of many socio-economic difficulties due to the impact of the COVID-19 pandemic and complicated developments of the world and regional situation.

 

Regarding citizen reception, the Standing Committee of the Law Committee requested the Government to supplement and clarify the reasons why Ministers and Heads of ministerial-level agencies "receive few, delegate many".

 

In addition, the report combining the number of days that heads of state administrative agencies at all levels directly receive citizens with the number of days that they authorize their deputies to receive citizens does not ensure compliance with the provisions of the Law on Citizen Reception, and does not accurately reflect the responsibility of the head of the agency in directly receiving citizens.

 

Regarding the results of receiving and handling complaints and denunciations, the Government needs to clarify the reasons for the increase in the number of complaints under the responsibility of ministries and branches, and the decrease in the number of complaints eligible for handling at higher levels, in order to have appropriate solutions to ensure the effectiveness and quality of this work.

 

Through analysis of the results of handling denunciations, the number of denunciations with correct content accounted for 23.5%, compared with the rate in 2022 of 18.7%, showing that the situation of violations in the performance of official duties by cadres and civil servants is higher than the previous year.

 

In addition, the number of subsequent denunciations with correct content accounted for 33.5%, compared to 36.1% in 2022, showing that although the error rate in handling first-time denunciations by state agencies has decreased, it is still high.

The inspection agency recommends that the Government clearly identify the causes and have more appropriate and drastic solutions to improve the quality of complaint handling.

 

Specify individuals and units that have not directly received citizens.

 

Members of the National Assembly Standing Committee said that the Government's Report clearly reflected the situation of receiving citizens, handling complaints and denunciations, with many specific figures; assessed the results achieved, shortcomings, limitations, and causes; on that basis, proposed a number of solutions to continue improving the effectiveness of this work in the coming time.

 

Chairwoman of the National Assembly's Judicial Committee Le Thi Nga said that the implementation of legal regulations on the responsibility of ministers and heads of ministerial-level agencies to directly receive citizens has not met requirements (only 45%). Therefore, Ms. Le Thi Nga suggested that it is necessary to clarify and publicize units whose leaders do not directly receive citizens, including provincial levels, heads and ministers of ministries and branches. If this is made public, the situation of receiving citizens next year will change positively.

 

Standing Vice Chairman of the National Assembly Tran Thanh Man said that compared to 2022, the number of people, cases and large groups of people making complaints, denunciations and petitions in 2023 increased sharply; accordingly, the number of cases increased by 37.5%, the number of people increased by 41.8% and the number of cases increased by 33.2%. The Standing Vice Chairman of the National Assembly requested to analyze and clarify the causes of this situation.

 

The Standing Vice Chairman of the National Assembly also noted that the Report clearly added the "addresses" of individuals, agencies and units that have not directly received citizens to determine responsibilities and have appropriate sanctions; thereby helping this work to change more positively.

Through contact with voters, Chairman of the National Assembly's Ethnic Council Y Thanh Ha Nie Kdam realized that for the prolonged mass complaints related to agricultural and forestry land, the solutions have not shown fundamental and specificity, especially in the issue of perfecting, organizing and enforcing the law.

 

Considering this to be the core step to fundamentally resolve voters' petitions and people's complaints, the Chairman of the Ethnic Council requested attention and clarification of this issue.

 

Regarding the work of information, propaganda and dissemination of law, Mr. Y Thanh Ha Nie Kdam assessed that this is also an important step to ensure the organization of law enforcement. However, in reality, the work of information and propaganda in ethnic minority and mountainous areas still faces some difficulties and obstacles; it does not meet practical requirements, legal reporters have limited knowledge of language, culture and professional skills. Some popular propaganda content is not close to the accessibility and needs of the people. Therefore, Mr. Y Thanh Ha Nie Kdam proposed to add this content to the report.

 

In addition, the Chairman of the Ethnic Council suggested that the border situation and security and order in ethnic minority and mountainous areas should be covered, because these areas still have potential complications related to religion and land. Authorities at all levels need to strengthen monitoring, grasp, and promptly handle, avoid passivity, surprise, and resolve arising issues.
