According to the provisions of the Law on Road Traffic Order and Safety 2024 (effective from January 1, 2025), motorcyclists must participate in compulsory civil liability insurance. This is not a new regulation; since 1988, Vietnam has applied compulsory insurance for motorbikes. Thus, since it is a legal regulation, traffic participants must comply. Moreover, in Vietnam, motorbikes and motorbikes are still the main means of motor transport, accounting for 63.48% of the causes of accidents.
The above statistics show that road users using motorbikes have not yet strictly complied with the provisions of the law. However, it is also necessary to ask why the rate of compulsory motorbike insurance is low while this insurance is regulated to protect the rights of road users. Previously, voters in many provinces and cities across the country proposed to abolish compulsory motorbike insurance. The reason given by voters was that this insurance was ineffective, claiming compensation when an accident occurred was troublesome, and the procedures were complicated.
In reality, when a collision occurs, most motorcyclists resolve the issue themselves because they believe that the insurance compensation is low and that it takes time and effort to resolve the issue. Many people express their views that because this is a compulsory type of insurance, all motor vehicle owners are responsible for purchasing it, so the quality of customer service from insurance companies is not given due attention.
Many people also contacted the insurance company but only found out that the procedures to resolve the issue were not simple. For example, it is not allowed to move, disassemble or repair the property without the approval of the insurance company (except in necessary cases or when required by the competent authority), while not everyone is aware of these regulations.
The above recommendations raise the issue that authorities and insurance companies need to have practical solutions to ensure the rights of motor vehicle owners as well as increase the rate of people participating in compulsory insurance for motorbikes. For a long time, many insurance companies such as PVI, MIC, BIC, PTI, Bao Viet... have provided compulsory civil liability insurance to customers in many forms such as: buying directly at the company's headquarters or at insurance distribution agents, banks, gas stations.
Vehicle owners can also buy online through phone apps such as momo, viettelpay, lazada or register on the online website of some reputable insurance companies. To increase the number of insurance products sold, many insurance companies increase preferential policies to attract buyers. There are times when many insurance companies "approach" customers at police vehicle inspection checkpoints. In cases where vehicle owners do not have compulsory motorbike insurance, they must buy on the spot.
The current regulations related to compulsory civil liability insurance for motor vehicle owners have inherited and supplemented many new regulations to simplify compensation procedures and increase benefits for vehicle owners regarding insurance premiums, insurance amounts, etc.
On January 15, 2021, the Government issued Decree 03/2021/ND-CP on compulsory civil liability insurance for motor vehicle owners. This Decree was issued based on a summary and assessment of the implementation in practice over the past time to facilitate the implementation of compulsory civil liability insurance for motor vehicle owners, including motorbikes, for people.
This Decree has reduced the number of insurance claim documents compared to before, while increasing the initiative and self-responsibility of insurance companies in settling insurance claims. Next, Decree No. 67/2023/ND-CP of the Government has also added many new regulations to simplify claim procedures and ensure the rights of insurance buyers.
Conducting a small survey of motorcyclists, the majority said that buying insurance is just to... deal with the police. Meanwhile, the nature of participating in this type of insurance is to bring benefits to motorcyclists. Accordingly, the insurance will pay for accident victims up to 150 million VND/person/accident; for property, the insurance will pay up to 50 million VND/incident.
This reduces the financial burden on road users in case of an accident. When traffic police check documents, vehicle owners are less likely to be fined because civil liability insurance is a necessary and mandatory document when participating in traffic. New regulations on administrative penalties for traffic violations from 2025 for the error of not having compulsory motorbike insurance (or expired motorbike insurance) from 200-300,000 VND instead of the previous level of 100-200,000 VND.
Therefore, motorcyclists need to be fully equipped with necessary documents, including compulsory insurance, to demonstrate their compliance with the law and protect their rights.
To increase the rate of motorbike owners participating in compulsory civil liability insurance, there needs to be a stricter mechanism for checking vehicles in circulation, ensuring that road users have all the necessary documents when on the road.
At the same time, the compensation regime in case of an accident must be satisfactory and flexible so that the buyer feels that this document really brings practical benefits to himself, thereby voluntarily participating. Currently, the market is selling many types of motorbike insurance with different prices, so vehicle owners need to find out information and should only buy compulsory motorbike insurance.
