The Ministry of Home Affairs completed the draft submission and draft Resolution of the National Assembly Standing Committee on administrative unit arrangement and transferred it to the Ministry of Justice for appraisal.
11 provincial administrative units do not carry out the arrangement
Implementing the Politburo's conclusions on "merging some provincial-level units, not organizing at the district level, merging some commune-level units", the draft Resolution stipulates the criteria for arranging provincial-level and commune-level units in the direction of closely following the 6 criteria that have been considered and agreed upon by the Politburo.
Including: natural area; population size; criteria on history, tradition, culture, religion, ethnicity; criteria on geo-economics (including geographical location, scale and level of economic development); criteria on geopolitics; criteria on national defense and security.
In which, the criteria of natural area and population size are determined according to Resolution 1211 of 2016 of the National Assembly Standing Committee (amended and supplemented in 2022).
Notably, the draft Resolution provides two cases where administrative unit arrangement is not required.
One is Administrative units are isolated and difficult to organize convenient traffic connections with adjacent administrative units.
Two is Administrative units have a particularly important position. If rearranged, it will affect national defense, security and the protection of national sovereignty.
Based on these criteria, the Ministry of Home Affairs' proposal predicts that 11 provincial-level administrative units will not be reorganized, including Hanoi, Hue, Lai Chau, Dien Bien, Son La, Cao Bang, Lang Son, Quang Ninh, Thanh Hoa, Nghe An, and Ha Tinh.
There are 52 provincial-level administrative units that need to be rearranged, including 4 cities: Hai Phong, Ho Chi Minh City, Da Nang, and Can Tho.
And the 48 provinces are Ha Nam, Hung Yen, Vinh Phuc, Bac Ninh, Thai Binh, Hai Duong, Nam Dinh, Ninh Binh, Bac Kan, Thai Nguyen, Phu Tho, Bac Giang, Hoa Binh, Tuyen Quang, Lao Cai, Yen Bai, Ha Giang, Ninh Thuan, Quang Tri, Phu Yen, Quang Binh, Quang Ngai, Khanh Hoa, Dak Nong, Tay Ninh, Binh Duong, Binh Thuan, Binh Phuoc, Ba Ria - Vung Tau, Ben Tre, Bac Lieu, Vinh Long, Hau Giang, Tra Vinh, Tien Giang, Soc Trang, Dong Thap, An Giang, Long An, Ca Mau, Quang Nam, Binh Dinh, Dak Lak, Dong Nai, Gia Lai, Kon Tum, Lam Dong, Kien Giang.
39 commune-level administrative units are not subject to rearrangement.
In the draft Resolution, the Ministry of Home Affairs proposed the standards and number of administrative units of communes and wards after the arrangement.
Accordingly, the new commune after the arrangement must have both natural area and population size reaching 300% or more of the commune standards prescribed in the resolution of the National Assembly Standing Committee on standards of administrative units and classification of administrative units.
As for the population size standard of a commune in a mountainous area, highland area or one with a national border on land where 30% or more of the population is ethnic minorities, the minimum is 7,500 people.
For new wards after the arrangement, the draft Resolution requires that they have a natural area of 35km2 or more; a population of 50,000 people or more; and wards in mountainous and highland areas must have a population of 35,000 people or more.
In case of arranging 4 or more commune-level administrative units into 1 new commune or ward, it is not necessary to evaluate the standards of natural area and population size according to regulations.
In case the arrangement of administrative units is in accordance with the direction of competent authorities and ensures the provisions of this resolution, the conditions will not be considered and other standards will not be assessed according to the provisions of the Law on Organization of Local Government and the resolution of the National Assembly Standing Committee on standards of administrative units and classification of administrative units.
Also according to the proposal of the Ministry of Home Affairs, the total number of administrative units of communes and wards after the rearrangement will be reduced by at least 70% and at most 75% compared to the total number of administrative units at the commune level before the rearrangement in the province or centrally-run city.
With the above criteria, it is expected that the whole country will have 9,996/10,035 commune-level administrative units subject to rearrangement.
According to the latest information from the Ministry of Home Affairs, with the orientation of arranging and merging a total of 10,035 commune-level administrative units to about 5,000 units, this agency is consulting, building and completing the latest draft of the Resolution of the National Assembly Standing Committee on the arrangement of administrative units, and at the same time sending it to localities for comments.
