Proposal to add more content related to identification and install driver monitoring devices

The bill amending and supplementing a number of articles of 10 laws related to security and order has proposed adding many contents related to identification and installing driver monitoring devices.

On the afternoon of September 23, the Standing Committee of the National Assembly gave its opinion on the draft Law amending and supplementing a number of articles of 10 laws related to security and order.

The 10 laws include the Law on Security Guarding; the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam; the Law on Exit and Entry of Vietnamese Citizens; the Law on Residence; the Law on Identity Cards; the Law on Forces Participating in Protecting Security and Order at the Local Level; the Law on Road Traffic Order and Safety; the Law on Roads; the Law on Management and Use of Weapons, Explosives, and Support Tools; and the Law on Fire Prevention, Firefighting, and Rescue.

Proposal to allow citizens to renew their identity cards online.

Specifically, with regard to the Identity Card Law, the drafting agency proposed adding more cases in which identity cards can be revoked.

The regulations stipulate that individuals issued with electronic identity cards must present their electronic identity cards upon request from competent agencies, organizations, or individuals. Therefore, those agencies, organizations, or individuals are prohibited from requesting the electronic identity card holder to present other documents or provide information already integrated into the electronic identity card.

Regarding this matter, the drafting agency argues that the current law regulating the validity of electronic identity cards does not stipulate that the cardholder must present the card upon request from competent agencies, organizations, or individuals. Therefore, agencies, organizations, and individuals are not allowed to request the cardholder to present documents or provide information already printed or integrated into the identity card.

In addition, it is proposed that in cases where the information has changed compared to the information on the identity card, the cardholder must provide legally valid documents to prove that the information has changed.

This has led to many agencies, organizations, and individuals still requiring citizens to present documents or provide information that has already been integrated into their electronic identity cards.

Therefore, it is necessary to add a provision that does not require the presentation of documents or the provision of information already integrated into the electronic identity card.

The drafting agency emphasized that failure to promptly add this regulation would negate the value of integrating information into electronic identity cards, preventing citizens from seeing the benefits of using them.

The bill also adds provisions for cases where the information on the identity card changes due to administrative unit reorganization, or where the identity card is lost or damaged and unusable, allowing the individual to apply for a replacement or reissue of the identity card online through the public service portal, the national identification application, or in person at the place where the identity card is issued.

Proposal: Commercial vehicles with fewer than 8 seats must be equipped with driver monitoring devices.

Regarding the Law on Road Traffic Order and Safety, the drafting agency proposed adding regulations requiring internal transport vehicles to install vehicle tracking devices and driver image recording devices.

Accordingly, passenger vehicles with fewer than 8 seats (excluding the driver's seat) used for commercial transportation must install a device to record the driver's image. Passenger vehicles with 8 or more seats (excluding the driver's seat) used for commercial transportation must install a device to record the image of the passenger compartment.

Information from the drafting agency indicates that after seven months of implementing the Law on Road Traffic Order and Safety, the management of commercial transport vehicles through vehicle tracking devices and driver image recording devices remains very limited and has not met practical requirements.

Specifically, passenger cars with fewer than 8 seats are not yet required to install driver image recording devices, thus hindering the management and monitoring of drivers who violate the law.

Examples include not wearing a seatbelt, taking both hands off the steering wheel, using feet to steer, using a phone with your hands while driving, speeding, etc.

It is not yet possible to warn drivers when they show signs of abnormal driving behavior that could compromise safety, such as drowsiness or lack of concentration, which poses many risks of traffic accidents.

The drafting agency added a regulation requiring internal transport vehicles to be equipped with vehicle tracking devices and driver image recording devices. While these vehicles are formally transporting people and goods for the unit or enterprise, they are essentially participating in traffic like other commercial transport vehicles.

At the same time, these vehicles transporting people and goods are also a source of high danger (carrying many people on board, vehicles transporting large quantities of goods).

Therefore, it is necessary to monitor and manage drivers and their routes to ensure their safety and the safety of other road users.

The drafting agency stated that adding this regulation is essential and urgent, creating a legal basis for monitoring, managing, supervising, detecting, and promptly handling violations of the law that endanger safety...

Regarding this matter, the Chairman of the National Defense, Security and Foreign Affairs Committee, Le Tan Toi, stated that there were suggestions to conduct a full and comprehensive assessment of the impact on compliance costs and the right to privacy regarding regulations requiring vehicles to be equipped with vehicle tracking devices and devices that record images of the driver and passenger compartment.

At the same time, it is suggested that the regulation requiring the installation of passenger cabin monitoring devices be reconsidered, as it does not yet involve personal data and the privacy of passengers.

The bill also removes the regulation that commercial vehicle drivers cannot drive more than 48 hours per week. Instead, it amends the regulations on continuous driving time for drivers in a day and a week to comply with the provisions of the Labor Code…
