On the morning of May 26, continuing the 5th session, chaired by National Assembly Chairman Vuong Dinh Hue, the National Assembly listened to Chairman of the Committee for Science , Technology and Environment Le Quang Huy present a report explaining, accepting and revising the draft Law on Consumer Rights Protection (amended).
The Chairman of the Committee on Science, Technology and Environment said that there are two different opinions on the concept of consumers. The first opinion suggests that consumers include organizations. The second opinion believes that it is not necessary to include "organization" in the concept of "consumer". After studying the opinions of National Assembly Deputies, the National Assembly Standing Committee agreed to add the subject "organization" to the content of the regulation explaining the term "consumer"; at the same time, add the term "sustainable consumption".

Regarding the rights and obligations of consumers, taking into account the opinions of National Assembly Deputies, the draft Law has added a provision in Clause 10, Article 4 in the direction that when using public services, consumers are protected according to the provisions of this Law and other relevant laws. At the same time, to prevent the provision of services that do not ensure quality, the draft Law has added Article 36 on the responsibilities of business organizations and individuals in providing services (including public services) that are not in accordance with the registered, notified, announced, and contracted content.
Supplementing the obligations of consumers, specifically: "Ensure accurate and complete provision of information related to transactions between consumers and business organizations and individuals. Be responsible for providing inaccurate or incomplete information according to the provisions of law". The draft Law stipulates that the obligation to inspect goods is carried out according to the provisions of law, not mandatory for all products, goods and services.

Regarding the protection of consumer rights in specific transactions, Chairman of the Committee for Science, Technology and Environment Le Quang Huy said that the draft Law has many specific provisions on the protection of consumer rights in transactions between consumers and organizations and individuals doing business in cyberspace, such as regulations on organizations and individuals doing business in cyberspace having common responsibilities; regulations on transactions in cyberspace, transactions on digital platforms (authentication of identities of organizations and individuals selling goods, providing services on digital platforms)... In addition, this content is also regulated according to the law on e-commerce as well as other relevant laws.
Regarding the activities of social organizations in protecting consumer rights, the draft Law has many provisions to facilitate social organizations to participate in protecting consumer rights (including the Consumer Protection Association) such as: Representing consumers to initiate lawsuits when requested and authorizing or personally initiating lawsuits to protect consumer rights for the public interest... At the same time, the draft Law has specifically stipulated the activities of the Association when participating in protecting consumer rights and clearly classified the types of social organizations to have a basis for implementing the State's assignment of tasks, financial support and other conditions according to the provisions of law.
Vice Chairman of the National Assembly Nguyen Duc Hai suggested some topics for discussion.
Regarding dispute resolution in court, the National Assembly Standing Committee chose the option of clearly stipulating the application of simplified procedures to resolve civil cases on consumer rights protection. At the same time, to ensure that transactions of VND 100 million or more can still apply the simplified procedures prescribed in the Civil Procedure Code, the draft Law is amended in the direction that civil cases on consumer rights protection are resolved according to the simplified procedures prescribed in the law on civil procedures when meeting the provisions of Clause 1, Article 317 of the Civil Procedure Code or when meeting a number of specific conditions prescribed in the draft Law.
In addition, absorbing the opinions of National Assembly Deputies, the draft Law has reviewed, adjusted and perfected regulations to ensure a balance of interests of business organizations and individuals in their relationship with consumers.
