Proposing additional tasks for the People's Committee at the commune level in organizing the implementation of planning

Continuing the 9th Session, on the morning of May 28, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Planning. In this amendment, the draft Law focuses on 3 urgent issues that need to be addressed immediately in the near future.

Firstly, supplement transitional regulations on planning adjustment, ensuring immediate adjustment of planning at all levels after the administrative unit arrangement takes effect.

Second, promote decentralization and maximum delegation of power, enhance autonomy, proactiveness, creativity, and self-responsibility of all levels and sectors.

Third, continue to remove difficulties and problems arising in practice that can be handled immediately.

Regulations on the role of commune level in planning

Participating in contributing opinions, delegate Nguyen Tam Hung - National Assembly Delegation of Ba Ria - Vung Tau province proposed to consider and add new content to the draft Law to demonstrate the role of the commune level in planning.

Accordingly, delegates proposed to clearly define that commune-level authorities are the coordinating entities in the planning system, responsible for participating in providing information, proposing planning options and coordinating the implementation of planning in the area.

Delegates said that the above regulation is necessary in the context of organizing two-level local government, ensuring continuity and practicality in organizing law enforcement.

At the same time, delegate Hung suggested that the drafting agency consider adding to Clause 4, Article 16 of the draft Law on the provincial planning process, clearly defining the responsibility of the provincial planning agency in obtaining official opinions from the People's Committees at the commune level, as well as requiring the People's Committees at the commune level to provide data and propose orientations for the development of trade space and production infrastructure in their localities.

"For a long time, many opinions from the commune level have not been substantially integrated into the provincial planning, leading to difficulties in implementation, especially in rural and mountainous areas," said delegate Nguyen Tam Hung.

The delegate also said that although the commune level does not have the right to decide on planning, it is the place that directly manages the current status of land use and population. If there is no mechanism to bind the role of the commune level, the implementation of planning will lack strength.

Therefore, the delegate proposed to add the content of the regulation that the People's Committee at the commune level is responsible for coordinating the implementation of the planning plan in the area, monitoring the land use situation, infrastructure investment according to the approved planning, and periodically reporting to the provincial agency.

In addition, it is necessary to clearly define the responsibilities of the People's Committee at the commune level in organizing planning propaganda, supervising the implementation of planning in the area, receiving recommendations from people and reporting to provincial agencies.

Do not let the commune wait for the province, the province waits for the central government.

Delegate Nguyen Thi Thu Nguyet - National Assembly Delegation of Dak Lak province assessed that planning plays a very special role in coordinating resource allocation and creating development space. Amending and supplementing a number of articles in the Law on Planning is necessary, meeting the requirements in organizing a new apparatus and expanding administrative boundaries.

Through studying the draft Law, delegates found that there are no regulations to clarify the feedback mechanism between the planning agency and the Appraisal Council. According to delegates, in the procedure for submitting documents for approval and appraisal of planning, there is a content that is the conclusion of the Appraisal Council.

The delegate raised the question, if during the implementation process, the planning agency does not complete the above conclusions, how will it be resolved, how will it respond to submit to competent authorities if there are any problems in practice...

At the same time, the delegate said that the provisions on collecting opinions on planning adjustments mentioned in the draft Law do not ensure feasibility in practice. The delegate raised the issue of how to resolve the issue if local agencies collect opinions but the ministries and branches in charge do not respond.

"I propose to study in the direction that the agencies that are asked for opinions are responsible for responding in writing within 20 days from the date of receiving the documents. If the agencies do not respond within the above time limit, it is considered as agreement," said delegate Nguyen Thi Thu Nguyet.

According to the delegate, the above regulation will avoid the situation of "communes waiting for the province, the province waiting for the central government, causing waste of resources and loss of opportunities in receiving projects for economic and social development".
