Adjusting coefficient K to calculate land use fees

In recent years, investment in infrastructure in the province from central and local capital, especially capital for domestic and foreign traffic, has contributed to completing many key traffic routes in our province.

In particular, the two expressways Phan Thiet - Dau Giay, nearly 100 km long, Vinh Hao - Phan Thiet, more than 100 km long, have just been put into operation, connecting the routes in the province, shortening the traffic between Binh Thuan and the Southeast region by half compared to before. According to surveys of districts, towns and cities, sustainable traffic infrastructure is a key factor in increasing land prices in many places. The Provincial People's Committee issued Decision No. 06/2023/QD-UBND on the land price adjustment coefficient (coefficient K) in the province in 2023 in accordance with the socio-economic development in the area.

According to Decision No. 06/2023/QD-UBND on regulations on land price adjustment coefficient (coefficient K) in the province in 2023. This coefficient K is the basis for calculating land use fees for organizations, households and individuals who are allocated land by the State with land use fees and land use rights recognized. At the same time, coefficient K is also the basis for calculating land use fees or land plots with value (calculated according to land prices in the land price list) prescribed by the Provincial People's Committee with a value of less than 20 billion VND; determining the annual land rental price and determining the starting price in the auction of land use rights for land lease in the form of annual land rental. Coefficient K is also used to determine the illegal profits obtained from committing administrative violations in the land sector, according to the provisions of Article 7 of Decree No. 91 of the Government . At the same time, other cases where the law stipulates the application of the land price adjustment coefficient prescribed annually by the Provincial People's Committee to determine the financial obligations to be paid, as well as applying this coefficient K.

The new coefficient K takes effect from May 30, 2023. In Decision No. 06/2023, the Provincial People's Committee also abolished Decision No. 22/2022/QD-UBND dated July 22, 2022 of the Provincial People's Committee on the land price adjustment coefficient in Binh Thuan province in 2022. For cases applying the land price adjustment coefficient to determine specific land prices prescribed in Article 3 of this Decision, where the time of land price determination is from January 1, 2023 to before the effective date of this Decision, the land price adjustment coefficient prescribed in Decision No. 22/2022/QD-UBND dated July 22, 2022 of the Provincial People's Committee shall be applied for implementation.

Currently, the prices of land types in the province are being applied according to the land price list for the period 2020 - 2024. According to the land price list for the period 2020 - 2024, the highest residential land price in Phan Thiet City is Nguyen Hue Street, at 69,000,000 VND/m2. With a coefficient of 2.0 (Decision No. 06/2023/QD-UBND), the highest residential land price in Phan Thiet City is 138,000,000 VND/m2. According to the recently approved decision, the coefficient of land price adjustment on traffic routes and residential areas in communes in Phan Thiet City ranges from 2 - 2.17 times; the coefficient of land price adjustment in rural areas along main traffic routes ranges from 2 - 2.25 times; The coefficient of land price adjustment in urban areas of inner-city wards in Phan Thiet city, except for Dao Tan street (from Hung Vuong to Vo Van Kiet) has a coefficient of 1, most of the remaining streets have a coefficient of 2 times, the highest is 2.64 times. In La Gi town, the coefficient of land price adjustment on roads named after communes ranges from 1.41 to 1.77 times; the coefficient of land price adjustment in rural areas along main traffic routes ranges from 1.43 to 1.71 times; the coefficient of land price adjustment in urban areas ranges from 1.12 to 1.81 times...
