In particular, Decree No. 147/2024/ND-CP clearly states the operating conditions of public Internet access points.
According to regulations, Internet agents are allowed to operate when they meet the following conditions: Registering an Internet agent business; signing an Internet agent contract with an enterprise providing Internet access services; in case of providing electronic game services, they must have a certificate of eligibility to operate a public electronic game service point.
Decree No. 147/2024/ND-CP clearly states that the owner of a public Internet access point of an enterprise does not have to register as an Internet agent and sign an Internet agent contract. In case of providing electronic game services, a certificate of eligibility to operate a public electronic game service point is required.
Owners of public Internet access points at hotels, restaurants, airports, wharves, bus stations, coffee shops and other public places when providing Internet access services to users within these locations: Do not have to register an Internet agency business and sign an Internet agency contract if they do not collect fees; must register an Internet agency business and sign an Internet agency contract if they collect fees.
People's Committees of provinces and centrally run cities shall prescribe measures on the operating hours of Internet agents and public Internet access points that do not provide electronic game services in their localities.
Internet agents shall not permit Internet users to use the computer features at the business location to engage in prohibited conduct.
Decree No. 147/2024/ND-CP clearly states that Internet agents are responsible for: Setting up a terminal system at the authorized location to provide Internet access services to service users at that location; posting a sign "Internet Agent" which includes information about the Internet agent's business registration number. In case the Internet agent is also a public electronic game service provider, the sign must be posted according to regulations; providing Internet access services according to the quality and price stated in the Internet agent contract.
In the case of providing online electronic game services, Internet agents also have the responsibility of the owner of the public electronic game service provision location according to regulations; they are not allowed to organize or allow Internet users to use computer features at their business location to perform prohibited acts according to the provisions of Article 8 of the Law on Cyber Security, Article 9 of the Law on Telecommunications...
Providing electronic game services must comply with the prescribed operating hours.
The owner of a public Internet access point of an enterprise shall have the following responsibilities: Post a sign "Public Internet access point", which includes information about the enterprise's name and the enterprise's Internet service license number; in case the public Internet access point is also a public electronic game service provider, the sign shall be posted according to regulations; the public Internet access point of an enterprise that does not provide electronic game services shall comply with the operating hours prescribed by the People's Committee of the province or centrally-run city. The public Internet access point of an enterprise that provides electronic game services shall comply with the operating hours prescribed.
Internet users are responsible for: Complying with the operating hours of public Internet access points; complying with regulations on ensuring network information safety, network information security and other relevant regulations.
Vietnamese citizens aged 18-23 are given priority and support in registering to use third-level domain names under ".id.vn"
In addition, the Decree also clearly stipulates the registration and use of domain names.
The Decree stipulates that the Ministry of Information and Communications (Vietnam Internet Center) manages the Vietnamese national domain name ".vn" and international domain names that international organizations allocate and grant to agencies, organizations, businesses and individuals in Vietnam.
Agencies, organizations, businesses and individuals have the right to register Vietnamese national domain names ".vn" and international domain names.
Vietnamese citizens from 18 to 23 years old are given priority and support in registering to use the third-level domain name under ".id.vn" including: exemption and reduction of registration fees for using the Vietnamese national domain name ".vn"; exemption and reduction of maintenance fees for using the Vietnamese national domain name ".vn" within a specific period according to the provisions of law on fees and charges. Enterprises and business households with business household registration certificates according to the provisions of law are given priority and support in registering to use the third-level domain name under ".biz.vn" including: exemption and reduction of registration fees for using the Vietnamese national domain name ".vn"; exemption and reduction of maintenance fees for using the Vietnamese national domain name ".vn" within a specific period according to the provisions of law on fees and charges.
Domain name revocation cases
The Decree also specifies cases of domain name revocation, including:
Implement the request to revoke the domain name in the decision, judgment, or ruling on domain name dispute resolution of competent agencies and organizations or in the Conciliation Document according to the provisions of law on conciliation;
Implement the decision of the Minister of Information and Communications in cases of domain name revocation serving national interests, public interests, socio -economic development, national defense, security or no longer suitable for Internet resource planning as prescribed in the Law on Telecommunications;
Implementing the decision to sanction administrative violations of the competent authority to handle administrative violations in information and communications or other specialized inspectors, applying remedial measures such as revoking domain names or applying additional sanctions such as confiscating exhibits and means of violation;
Comply with written requests from investigation agencies or competent state agencies to promptly prevent acts of using domain names that violate national security, social order and safety according to the provisions of law;
Applicable to Vietnamese national domain names ".vn" that do not pay the full fee to maintain the use of Vietnamese national domain names ".vn" within 30 days from the due date of payment;
Cases where the domain name registration information is incorrect, the domain name registrant cannot be identified and the domain name registrant does not update, supplement or complete the information; the domain name is registered in violation of management regulations on structure and registered users; the domain name subject is an organization or enterprise that has been dissolved, bankrupt, or no longer exists without a valid transfer of usage rights to another subject according to the provisions of law; the individual has passed away without a valid transfer of usage rights to another subject according to the provisions of law.
