Who must participate in first aid and emergency training?

(Chinhphu.vn) - Mr. Pham The Anh (Hai Phong) asked, do workers who have participated in safety training for groups 2, 3, 4, 5, 6 according to the training framework prescribed in Decree No. 44/2016/ND-CP still need to conduct first aid and emergency training according to Circular No. 19/2016/TT-BYT?

According to Article 9 of Circular No. 19/2016/TT-BYT dated June 30, 2016 of the Minister of Health guiding the management of occupational hygiene and health of workers, the subjects of first aid and emergency training include: workers, except for those who have a Certificate of occupational safety and hygiene training; people assigned to participate in the first aid and emergency force.

However, according to Decree No. 44/2016/ND-CP dated May 15, 2016 of the Government detailing a number of articles of the Law on Labor Safety and Hygiene on labor safety technical inspection activities, labor safety and hygiene training and labor environment monitoring, for groups 2, 3, 4, 5, 6, the training content includes first aid and first aid for labor accidents.

Regarding this issue, the Ministry of Health responded as follows:

Pursuant to Article 9 of Circular No. 19/2016/TT-BYT dated June 30, 2016 of the Minister of Health on guidelines for management of occupational hygiene and employee health:

"1. First aid and emergency training subjects include:

a) Employees, except in cases where they have a certificate of occupational safety and hygiene training;

b) Person assigned to participate in first aid and emergency response forces".

Based on the above regulations, employees in groups 2, 3, 4, 5, 6 who have participated in occupational safety and hygiene training according to the training framework prescribed in Decree No. 44/2016/ND-CP and have a Certificate of occupational safety and hygiene training, a safety card, and have signed a book confirming that they have received occupational safety and hygiene training, including training in first aid for occupational accidents, do not need to undergo first aid and emergency training according to Circular No. 19/2016/TT-BYT.

However, those assigned to participate in the first aid and emergency response force must undergo first aid and emergency response training according to the provisions of Circular No. 19/2016/TT-BYT of the Ministry of Health.
