Axis 1 - Northwest Road Project: Stuck with site clearance

Stuck in clearance due to building houses on agricultural land

According to the Management Board of Investment and Construction of Traffic Works in Da Nang , the project of Axis 1 - Northwest Road (section from Ho Tung Mau intersection to the railway in Hoa Minh ward) started construction in early March 2020, with a construction period of 355 days. However, up to this point, the project has been forced to stop because the site clearance process is too slow.

According to the Lien Chieu District Land Clearance Board, the project is planned and cleared over ^76,000m2 . In Hoa Minh Ward alone, 137 files must be cleared, currently more than 122 files have people receiving money and handing over the land, the remaining 15 files related to the construction of Truc 1 - Tay Bac route belong to the clearance of the technical infrastructure project of Zone 1 of the Tay Bac New Urban Center, people have not yet handed over the land.

Mr. Dinh Huu Phuc, Chairman of the People's Committee of Hoa Minh Ward, said that among the 15 files that people have not yet handed over the land, most of them are due to many households building houses on non-residential land, not being compensated for the land and being resettled, so they have requested to prolong the process and have not yet complied with the land clearance. "The ward has requested the District People's Committee to review the legal procedures of each household to have a direction for handling land recovery in the coming time," said Mr. Phuc.

At the intersection of Axis 1 - Northwest - National Highway 1A, right at the entrance to Hoa Khanh Industrial Park in Hoa Khanh Bac ward, after the mobilization team of the ward and district went to each household to explain the compensation and support policies of the city and district as well as the common benefits when the project was completed, most households complied with the handover of the land. Mr. NHC (Hoa Khanh Bac ward) - a household subject to clearance in the area of the Axis 1 - Northwest intersection project said: "After the district and ward officials answered questions about the compensation policy, my family complied with the handover of the land so that the project could continue to be implemented."

Mr. Dang Duc Nhat, Chairman of Hoa Khanh Bac Ward People's Committee, said that up to now, at the intersection of Axis 1 - Northwest - National Highway 1A, the site clearance work for 53 files has been completed. The construction unit is urgently connecting the wastewater system to the area in front of the gate of Hoa Khanh Industrial Park, paving sidewalks and asphalt at this intersection. However, the entire route of the project located in Hoa Khanh Bac Ward still has many households that have not handed over the site to the construction unit, although the locality has mobilized households many times.

Project suspended due to lack of land

According to the Management Board of the Investment and Construction Project of Traffic Works in Da Nang, the section from Ho Tung Mau Street to National Highway 1A alone has 2 sections. The section from Ho Tung Mau to the railway started construction on March 3, 2020, and was scheduled to be completed on April 30, 2022. However, the project has been stuck with 15 households who have not yet handed over the land, so construction has been suspended since April 30, 2022 due to lack of land. The section from the railway to National Highway 1A has a total of 164 clearance files. To date, only 87 files have handed over the land, while the remaining 77 files have not yet handed over the land. Meanwhile, the 87 files hand over clean land but are interspersed like leopard skin, so there is no continuous land for construction.

According to the records, because the project could not be implemented on time, the slow site clearance work caused people in the project area to suffer from pollution, and their houses were degraded but could not be repaired. Around the houses of the people in the project area, grass and trees grew wildly, the houses were old and degraded, and the urban beauty was lost. According to the Management Board of the Investment and Construction Project of Da Nang Traffic Works, although the unit had repeatedly proposed and recommended that Lien Chieu district complete the site clearance work soon to construct the project.

Specifically, at the section from Ho Tung Mau to the railway, the locality is requested to urgently complete site clearance for the remaining 15 files. At the section from the railway to National Highway 1A, the Lien Chieu District Site Clearance Council is requested to speed up site clearance for the remaining 77 files; especially site clearance for files related to opening public roads so that the construction unit can continue to bring in machinery and vehicles to implement the project.

According to the People's Committee of Lien Chieu District, currently the project has 40 clearance cases located on 2 projects (1 part of the project of the Axis 1 - Northwest route is being implemented and 1 part of the project of the Residential Area on both sides of the Axis 1 - Northwest (Bau Vang Lake area). Previously, the city had a policy for complete clearance, however, the project of the Residential Area on both sides of the Axis 1 - Northwest (Bau Vang area) is currently planned at 1/500 in Decision No. 7435/QD-UBND dated October 8, 2015; currently the project has not been implemented, there is no land use plan, no capital plan and households have not complied with the handover of the site. Therefore, the People's Committee of the district has consulted each household and established procedures for land recovery according to regulations. For cases that have been compensated properly and sufficiently according to regulations, the People's Committee of the district has completed the dossier to establish procedures for compulsory land recovery.

Mr. Hoang Thanh Hoa, Chairman of the People's Committee of Lien Chieu District, said that first of all, the wards where the project is implemented need to strengthen inspection and supervision in compensation and site clearance work. The district has organized meetings and dialogues with households to find solutions to quickly clear the remaining land. "Among them, the most difficult are still households building houses on agricultural land, unable to arrange resettlement. Therefore, the district has sent a document requesting the Land Registration Office to conduct inspection, review and confirmation of other land plots to have a basis to report to the City People's Committee for consideration of accommodation," said Mr. Hoa.
