On March 1, the People's Committee of Dong Nai province held a meeting to publicly announce the Government Inspectorate 's announcement on the results of inspections, complaints and denunciations of citizens related to land acquisition for the Phuoc Tan Residential and Resettlement Area project (Phuoc Tan Ward, Bien Hoa City, Dong Nai).
Phuoc Tan Residential and Resettlement Area Project is nearly 50 hectares wide, located next to National Highway 51.
According to the announcement of the Government Inspectorate, through checking the contents of citizens' complaints and reflections, many contents have basis.
Specifically, regarding the citizen's complaint that the compensation land price is not close to the market price, the Government Inspectorate stated: "The specific land price appraisal process still revealed shortcomings and limitations, and did not comply with the instructions of Circular 36/2024 of the Ministry of Natural Resources and Environment, Decree 44/2014 and Decree 01/2017 of the Government, leading to the compensation land price not reflecting the correct market land price at the time of land recovery".
The project is invested by An Hung Phat Infrastructure Development Joint Stock Company.
The Government Inspectorate requested the People's Committee of Dong Nai province to urgently inspect and re-determine specific land prices, as a basis for adjusting compensation plans in accordance with regulations, ensuring the legitimate rights and interests of people whose land is recovered.
Regarding the content of the reflection that Ms. Phan Thi My Thanh (former Vice Chairman of Dong Nai Provincial People's Committee) signed planning license No. 12 dated March 19, 2014 and document No. 7665 dated September 18, 2013 allowing An Hung Phat Infrastructure Development Joint Stock Company to establish phase 1 planning that is not in accordance with the provisions of the Land Law, the Government Inspectorate said that there is a basis.
The project still has more than 10 hectares of land that has not been allocated, dozens of households do not agree with the site clearance so they sent complaints and denunciations.
The Government Inspectorate also said that the content of the reflection that the investor transferred 700 commercial land plots in the form of illegal capital contribution is well-founded. Specifically, the project has not been assigned enough land area by the People's Committee of Dong Nai province according to the approved planning (10.1 hectares of land has not been assigned); the construction of essential technical infrastructure has not been completed; the acceptance has not been confirmed by the state agency but the investor has signed a capital mobilization contract, which is contrary to the provisions of law.
The project investor has illegally raised capital.
Based on the above results, the Government Inspectorate requests the Chairman of Dong Nai Provincial People's Committee to organize inspection, appraisal and approval of specific land prices close to market prices to ensure the rights of households whose land is recovered, on that basis, there is a plan to adjust compensation, support and resettlement policies according to regulations. Assign Dong Nai Provincial Police to receive documents and investigate the illegal capital mobilization of the project investor. If there is a violation of criminal law, it will be handled according to regulations.
Many infrastructure items of the project are not completed.
Directing competent authorities to inspect and review the implementation and compliance with legal regulations of the project. Identify the responsibilities of individuals and organizations that have committed the above violations and strictly handle them according to regulations. "During the review process, clearly identify responsibilities. If criminal violations are detected, immediately transfer them to the police investigation agency," the announcement stated.
Regarding An Hung Phat Infrastructure Development and Joint Stock Company, the Government Inspectorate requested the company to promptly correct existing violations and shortcomings, strictly comply with legal regulations on investment, land, construction, architectural planning, etc. and continue to closely coordinate with localities to effectively handle citizens' complaints, and pay attention to households whose land has been recovered and are facing difficulties in their lives.
Regarding the content of the households claiming that the Phuoc Tan Residential and Resettlement Area Project is a commercial business project, not subject to land acquisition by the State, the Government Inspectorate said that there is no basis. According to the Government Inspectorate, the project has both the investment objective of building a new residential area and the objective of resettlement and social housing, so it is subject to land acquisition approved by the Dong Nai Provincial People's Council, and the Dong Nai Provincial People's Council has approved it in Resolution No. 117 dated July 14, 2014.
