The draft Law on Teachers is currently being submitted to the National Assembly for initial consideration at the 8th Session of the 15th National Assembly. One of the new points proposed in the draft Law on Teachers is granting the education sector the autonomy to recruit and employ teachers.
Managing teachers based solely on administrative factors is no longer appropriate.
According to the agenda of the 8th Session of the 15th National Assembly , on November 9th, the draft Law on Teachers will be presented to the National Assembly for initial consideration.
The draft Law on Teachers is expected to create a breakthrough in building and developing the teaching staff, starting with changes in state management of teachers.
Compared to other human resources in the country, the teaching staff has distinct characteristics and a high degree of diversity, which determines the direction of state management of teachers.

According to the Ministry of Education and Training, there are currently nearly 1.6 million teachers nationwide. Thus, teachers constitute a large proportion of the nation's total human resources, especially the country's intellectual workforce; they represent the highest percentage of civil servants in all sectors and fields.
Teachers have a unique professional activity whose product is the character of their students. Given the development goals and the distinct yet diverse characteristics of teachers, a state management approach focused on personnel management – that is, managing administrative factors related to the employment of teachers while paying little attention to their potential and development – is not appropriate.
Instead, many argue that the focus should shift from personnel management to human resource management to create an environment and conditions that allow each teacher to develop to their fullest potential, have the greatest motivation to work, and contribute the most to education and training, ultimately achieving both their own goals and the goals of education. In this process, teachers, both in public and private schools, can understand themselves, their profession, their mission, and their career path, thus clearly defining their training and development direction.
To address the above requirements, the draft Law on Teachers proposes granting the education sector the autonomy to recruit and employ teachers.
Specifically, the Ministry of Education and Training (MOET) and the Ministry of Labour, Invalids and Social Affairs are the lead agencies responsible for developing strategies, projects, and plans for the development and overall staffing of the teaching staff under their management, submitting them to competent authorities for decision; issuing criteria and standards for recruitment, and pedagogical practice content in teacher examinations/selections; and coordinating the staffing of teachers in public educational institutions according to the number allocated by competent authorities.
According to many experts, the aforementioned regulations aim to strengthen the leading role of educational management agencies in the state management of teachers, helping the education sector to be proactive in managing and developing the teaching staff. This is consistent with the Politburo's guiding principles in Conclusion No. 91-KL/TW dated August 12, 2024, on continuing fundamental and comprehensive reform of education and training.
Furthermore, with the aforementioned autonomy, the state management agency for education can manage the teaching staff based on expertise and quality, instead of using administrative tools that are unsuitable for the specific characteristics of this profession.
Professional-based management tools will help standardize the quality of the teaching staff, thereby improving the quality of the entire education system.
Furthermore, the regulations on state management of teachers designed in the draft Law on Teachers will help address many shortcomings in current state management of teachers, such as the long-standing problem of localized teacher shortages and surpluses at preschool and primary/secondary levels, and inadequacies in the management of teachers in non-public schools.
Delegate responsibility and autonomy in teacher recruitment and employment.
Sharing his views on the current state of state management of teachers in the locality, Professor Dr. Thai Van Thanh - Director of the Department of Education and Training of Nghe An province, and a member of the 15th National Assembly, acknowledged that the current state management of teachers reveals a number of difficulties and limitations in the planning and development of the teaching staff, selection, utilization, management, training, professional development, evaluation, classification, and implementation of remuneration for teachers.

Based on his assessment of the current state of teacher management, Mr. Thanh proposed that responsibility and initiative in teacher recruitment and employment should be assigned to educational management agencies; he also suggested solutions for state management of teachers.
In this context, teacher staffing planning needs to be comprehensive and long-term, ensuring the proactive role of education management agencies at all levels. Simultaneously, the recruitment and appointment of teachers should be reformed.
Regarding recruitment, Mr. Thanh proposed regulations specifying the content, form, and requirements for recruitment conditions and standards specifically for teachers, to ensure suitability with the unique characteristics of the teaching profession, minimize administrative and official duties, and strengthen requirements and assessments of pedagogical competence.
According to Mr. Thanh, it is also necessary to build a working environment for teachers that ensures adequate facilities, a conducive pedagogical environment, an educational environment, and safety for teachers in performing their duties.
Expectations for the draft Law on Teachers to be submitted to the 15th National Assembly for initial consideration at its 8th session are high. The Director of the Department of Education and Training of Nghe An province believes this will serve as a basis for enhancing the position and role of teachers, creating motivation for them to work with peace of mind and make significant contributions to the cause of education. The draft Law on Teachers has initially created a positive atmosphere among over 1.6 million teachers; it has received the consensus and support of parents and the public.
