The Department of Construction has recently drafted a decision regulating certain aspects of granting construction permits in Hue City.
Accordingly, the Department of Construction will issue construction permits for special and level I projects within the city. This includes construction projects located within the administrative boundaries of two or more communes.
For the City's Economic and Industrial Zone Management Board, the responsibility is to issue construction permits for projects located within the economic and industrial zones under its management.
In addition, the People's Committee at the commune level is authorized to issue construction permits for projects of level II and below, and individual houses (regardless of the project level) within its jurisdiction.
In case of conflict between the criteria for determining the authority to issue construction permits, the Department of Construction is the agency that selects the implementation method and reports to the City People's Committee for consideration and decision.
According to the Department of Construction, newly constructed buildings and individual houses are granted temporary construction permits with a maximum height of 2 floors (no basement or semi-basement), a total building height not exceeding 10 meters, and a total construction floor area not exceeding 160 square meters.
For buildings and individual houses undergoing repair and renovation, the total height of the building does not exceed 10m and the total floor area does not exceed 160 m2. In cases where the existing building or individual house is larger, the repair and renovation may be carried out while maintaining its original state (without increasing the construction area, total floor area, height, or number of floors).
Construction projects granted temporary permits are allowed to remain in existence until a decision is made to reclaim the land by a competent state agency. Upon expiration of the permit's validity period or when the state clears the land for planning purposes, the investor must demolish the entire structure granted the temporary permit. Failure to do so will result in forced demolition, and the investor will bear all costs associated with the forced demolition.
