Resettlement deadlock

The compensation and site clearance plan (GPMB) for the Phuoc An project was approved by Tien Phuoc District People's Committee in Decision No. 1298 dated July 5, 2016 with a total cost of VND 18,509 billion. At this time, compensation has been paid and the site has been handed over to 78 households out of 81 affected households; the total land area that has been GPMBed is 64,684/65,212m 2 (99.2%). Most households and individuals have agreed to receive money, demolish their houses, and hand over the site since 2016.

However, the remaining 3 households have not yet been allocated land for housing. The affected households all have their main source of income from agriculture , but after the land was recovered, there was still no suitable career conversion policy. The career conversion support policy still focuses on providing monetary support, and people are unemployed after their land was recovered.

Many households have large areas of recovered residential land, with many generations living together on the land, but the resettlement arrangement (in terms of number of plots and resettlement area) according to current regulations has not met the people's wishes, so compensation, site clearance, support and resettlement work has encountered many difficulties and is prolonged.

An example is the case of Mrs. Nguyen Thi Nu's household. The compensation plan, land acquisition support and the decision to recover Mrs. Nu's land were both approved by the Tien Phuoc District People's Committee on July 5, 2016. Specifically, at plot No. 56, map sheet No. 1, area 1,138.4m 2 (200m 2 of residential land and 938.4m 2 of garden and pond land), 1,017.4m 2 (96m 2 of residential land and 921.4m 2 of garden and pond land) were recovered. The remaining land area is 121m 2 (residential land 104m 2 , garden and pond land 17m 2 ). Mrs. Nguyen Thi Nu's household has 8 members, 3 couples (4 generations) actually living together on the recovered residential land.

Regarding the resettlement land allocation plan, in 2017 and 2021, Tien Phuoc District People's Committee agreed twice with Ms. Nu's household on the number of plots, location, resettlement area, compensation price for housing and resettlement price at the destination. Because the household has 3 couples, 4 generations living together, the remaining land area is 121m2 equivalent to 1 residential plot according to the planning, it was agreed to allocate resettlement land for 1 plot number H30 with an area of 108m2 (land for land of 96m2 and payment of 14m2 according to the approved resettlement price of 946 thousand VND/ m2 ) and allocate 1 plot number H31 with an area of 108m2 and payment of 100% according to the approved resettlement land price of 946 thousand VND/ m2 .

However, the resettlement plan for Ms. Nu's household at that time was not approved in time for resettlement. On December 21, 2021, the Provincial People's Committee issued Decision No. 42 replacing the previous compensation, support and resettlement policy. Accordingly, when applying for resettlement consideration and making a resettlement plan according to Decision No. 42, Ms. Nu's household was not eligible for resettlement land allocation. The matter has been stuck until now. Therefore, the Provincial People's Committee has adjusted the project completion deadline of the investor, Quang Nam Infrastructure Development Investment Joint Stock Company, 6 times.

Agree with the district's proposal

Mr. Tram Que Huong - Chairman of Tien Phuoc District People's Committee proposed to remove two obstacles: resettlement land price and resettlement policy. According to him, Clause 4, Article 254 of the 2024 Land Law specifically states that in cases where there is a decision to recover land and a decision to approve the compensation, support and resettlement plan before the effective date of this law, but after the effective date of this law, there is a decision to allocate resettlement land, the land price for calculating land use fees at the resettlement site is determined at the time of approval of the compensation, support and resettlement plan. On this basis, Mr. Huong proposed that the Provincial People's Committee consider and agree on the policy to allow Tien Phuoc district to apply the resettlement land price at the time of land recovery to calculate the resettlement land use fees for Ms. Nu's household and the remaining 2 households.

Clause 4, Article 111 of the 2024 Land Law stipulates that in cases where a household has many generations or many couples living together on a plot of residential land that is recovered, if they meet the conditions to separate into separate households according to the provisions of the law on residence, or there are many households sharing the right to use a plot of residential land that is recovered and the compensated residential land area is not enough to be allocated separately to each household, they will be considered for support to allocate residential land with land use fees or to sell, lease, or lease-purchase housing to households in need.

Mrs. Nguyen Thi Nu's household has 8 members, 3 couples (4 generations) actually living together on the recovered residential land plot of 1,017.4m2 . The remaining land area of 121m2 is not enough for the 3 couples living on the residential land plot.

Mr. Tram Que Huong proposed that the Provincial People's Committee consider allocating to Ms. Nguyen Thi Nu's household 2 resettlement plots according to the approved detailed subdivision plan in the resettlement area for the 2 remaining couples (1 couple still lives in the house within the area of 121m2 ).

“Tien Phuoc’s proposal is in accordance with the provisions of the 2024 Land Law, ensuring the previous commitment of the district and Ms. Nu’s household; at the same time, it is consistent with the aspirations and legitimate rights of the other two households. I hope the provincial leaders will unify the policy,” said Mr. Huong.

Vice Chairman of the Provincial People's Committee Tran Nam Hung agreed with the proposal of the district People's Committee leaders, and at the same time requested the locality to urgently have a written report and proposal for the Provincial People's Committee to consider and resolve.

"This must be done urgently and the Provincial People's Committee will not adjust the project completion schedule any further. It must be completed before May 2025," emphasized Vice Chairman of the Provincial People's Committee Tran Nam Hung.
