Effectiveness from implementing decentralization and delegation regulations

The promotion of the implementation of regulations on decentralization and delegation of authority in state management in the province has basically been consistent and effective. Decentralization and delegation of authority have promoted the autonomy, self-responsibility, dynamism and creativity of agencies and localities, meeting the requirements of administrative reform, improving the effectiveness and efficiency of state management.

Improve management effectiveness and efficiency

In recent times, the Provincial People's Committee has stepped up the implementation of decentralization tasks and delegation of state management authority in the province. Specifically, in the fields of natural resources and environment, transportation, health,education and training, culture, sports and tourism, labor - war invalids and social affairs (except for public asset procurement), from January 1, 2022 to July 31, 2024.

The Department of Labor, War Invalids and Social Affairs held a dialogue conference with foreign-invested enterprises on granting work permits.

Accordingly, the Provincial People's Committee has implemented decentralized tasks and delegated powers according to the provisions of Resolution No. 99/NQ-CP dated June 24, 2020 and Resolution No. 04/NQ-CP dated January 1, 2022 of the Government on promoting decentralization and delegation of powers in state management (Resolution No. 04/NQ-CP); issued many legal documents in various fields to specify the regulations of the Central Government; clearly defined the tasks, powers, authorities and responsibilities of departments, branches and localities in state management work in the locality. The strengthening of decentralization and delegation of powers in recent times has created initiative and increased responsibility of heads of agencies, units and localities, contributing to improving the effectiveness and efficiency of state management in the area.

According to the Provincial People's Committee, currently, the province's civil servant payroll assigned by the Central Government is low, the payroll allocated to departments, branches and localities does not ensure the performance of professional tasks; at the same time, it is still necessary to carry out the task of reducing the civil servant payroll by 5% compared to 2021. Therefore, implementing decentralization and authorization to specialized agencies and district-level People's Committees in state management of the fields and areas under management faces many pressures and difficulties in the process of performing decentralized and authorized tasks...

Mr. Trinh Duc Tai, Director of the Department of Labor, War Invalids and Social Affairs, said that the department seriously implemented and specified the decentralization and authorization to ensure compliance with regulations in the areas under the Department Office; the areas under the Department of Social Protection; the areas under the Department of Labor Policy; the areas under the Department of People with Merits; the areas under the Department of Planning and Finance; the areas under the Department of Vocational Education. In which, in the area under the Department of Labor Policy, the department implemented the authorization of the Provincial People's Committee on the issuance of labor certificates to foreigners. From June 12, 2023 to September 17, 2023, the department received the demand for foreign workers, changed the demand for foreign workers, approved job positions using foreign workers in the province for 2,389 employers with 3,417 approved job positions; Not approving job positions using foreign workers with 1,200 employers.

“The authorization has created many favorable conditions for the Department to be proactive in inspecting and resolving requests from employers. The Department has more time to process documents according to administrative procedures, minimizing late documents. Regarding employers, the Department has received, inspected and resolved them within the prescribed time. Thereby, employers can take the initiative in their work and not affect other related work,” said Mr. Trinh Duc Tai.

Similarly, decentralization and authorization to the Director of the Department of Transport has improved the effectiveness and efficiency of the sector's management. For example, the Provincial People's Committee has delegated authority to the department to decide on investment in construction projects using provincial road management and maintenance funds in the province. "By decentralizing authority to the department director to decide on investment in construction projects using provincial road management and maintenance funds according to decentralization, it has created conditions for project investors to be proactive in the implementation process, shortening the implementation time of maintenance and repair projects, contributing to ensuring traffic safety, promptly resolving voters' recommendations related to traffic safety work", said Mr. Nguyen Anh Minh, Director of the Department of Transport.

Proposing staffing, improving the effectiveness of decentralization and delegation

According to Mr. Ngo Quang Su, Director of the Department of Natural Resources and Environment, the implementation of decentralized tasks in the environmental sector is facing difficulties in the number of staff to effectively carry out assigned political tasks. Specifically, the Law on Environmental Protection 2020 assigns a number of new tasks to the environmental sector, such as licensing wastewater discharge into water sources integrated into environmental licenses; managing domestic waste; implementing biodiversity conservation work, etc., so there will be a number of new job positions and staff must be arranged to perform, especially with strong decentralization to localities, causing the workload to increase. Meanwhile, the staff for the environmental sector is decreasing, so with the current number of staff assigned, the team of civil servants and public employees is facing pressure and difficulties in the process of performing decentralized tasks.

Mr. Trinh Duc Tai shared that the volume of work that the department has to handle after being decentralized and authorized has increased, while the lack of staff has put pressure on personnel in performing these tasks and work at the department. Localities also reported common difficulties and obstacles in performing decentralized and authorized tasks, such as staff, facilities, and funding; localities have to balance their own budget or assign additional tasks to officials and civil servants to ensure the performance of these tasks.

Therefore, the Provincial People's Committee recommends that the Provincial People's Council pay attention, agree and recommend competent authorities to supplement the provincial civil servant payroll to ensure human resources to effectively perform state management work in the locality. At the same time, the Provincial People's Committee focuses on completing the draft Project on decentralization and delegation of authority in state management in the province and submit it to the meeting at the end of 2024 for the Provincial People's Council to consider and approve for implementation...
