The Supreme People's Procuracy has just issued an indictment to prosecute former Chairman of Binh Thuan Provincial People's Committee Le Tien Phuong and 16 other defendants for violating regulations on management and use of state assets, causing loss and waste.

According to the indictment, in 2013, Rang Dong Joint Stock Company received the transfer of all shares of Regent International Overseas Corp at Phan Thiet Golf and Golf Club LLC for 2.5 million USD.

Rang Dong Company inherits all rights and interests of the investor and Phan Thiet golf course project on the land area of ​​620,656m2 in Phu Thuy ward, Phan Thiet city, Binh Thuan and requests to change the purpose of using golf land to urban residential land.

In 2014, the Prime Minister issued an official dispatch on the adjustment of Phan Thiet golf course. The People's Committee of Binh Thuan province adjusted the investment from Phan Thiet golf course project to Phan Thiet coastal urban tourism project.

On April 10, 2015, Mr. Le Tien Phuong signed a decision to allow the change of purpose of use of 363,5236m2 of land for construction of sports facilities to urban residential land.

The accusation shows that Mr. Phuong and the defendants at related departments, branches and units committed violations in developing and appraising land price plans, approving specific land prices to calculate land use fees..., causing serious damage to state assets.

According to the Supreme People's Procuracy, this is an especially serious case that occurred in the field of state management of land in Binh Thuan province. The defendants with different roles intentionally violated their assigned tasks in the process of building and appraising land price plans; agreed to use the results of land price determination... The defendants' actions caused a loss of more than 308 billion VND to the state budget.

At the investigation agency, Mr. Phuong confessed and admitted to approving land prices for construction in violation of the law, causing especially serious damage to state assets.

According to the testimony of the former Chairman of Binh Thuan Province, because of the desire to speed up the approval of land prices, collect land use fees for the state budget soon, so that the project can be quickly implemented, create a highlight for the city's tourism, and contribute to the local socio-economic development, the defendant committed the crime. In addition, the land price plan for the project had been redone many times, so the defendant did not want to pass the responsibility of approving land prices to his successor.

According to the testimony of Mr. Nguyen Ngoc (former Standing Vice Chairman of Binh Thuan Provincial People's Committee), the reason for the defendant's crime was due to work pressure when the Chairman of the Provincial People's Committee often directed to speed up the approval of land prices, collect land use fees for the state budget soon so that the project could be quickly implemented, creating a highlight for the city's tourism, contributing to the development of the local socio-economy.

The Supreme People's Procuracy assessed that the group of defendants in the Appraisal Council honestly confessed and admitted to violations in the process of appraising land price determination results and land price plans, causing especially serious damage.

Regarding the cause of the crime, the defendants stated that due to the pressure of progress and direction from superiors, the land price plan had been redone many times, so they agreed with the land price plan and explanation of the Department of Natural Resources and Environment to soon collect for the state budget according to the general direction of the Provincial Party Standing Committee, Provincial People's Committee...
