Hung Yen: Tan Hung Construction Company won 5 consecutive bid packages invited by R-EMC Company

Specifically, the 5 bid packages that Tan Hung Construction Company won are:

1. Package No. 01: Construction of the Project to Improve and Upgrade the Rural Traffic Road in Binh Minh Commune from Mr. Chuong's house to Mr. Dinh's house, Hamlet 1, Da Hoa Village, invested by the People's Committee of Binh Minh Commune.

This bid package costs 5,341,436,000 VND, and only Tan Hung Construction Company participated in the bid.

The expert team was established by R-EMC Company based on Contract No. 18.03/2025/HDKT-TVDT dated March 18, 2025 between Binh Minh Commune People's Committee and R-EMC Company to prepare bidding documents and evaluate bidding documents for Package No. 1: Construction of the project to renovate and upgrade the rural traffic route in Binh Minh Commune from Mr. Chuong's house to Mr. Dinh's house, Hamlet 1, Da Hoa Village.

2. Package No. 01: Construction of the Project of Headquarters, subject classrooms and auxiliary items of Tan Dan Secondary School, invested by Tan Dan Commune People's Committee.

This bid package costs 19,623,696,000 VND and only one contractor is participating, the joint venture of Tan Hung Construction Company and Phuong Nam Mechanical, Electrical and Fire Protection Company Limited.

The expert team was established by R-EMC Company based on Decision No. 11.4/2025/QD-TCG dated April 11, 2025 of R-EMC Company to prepare bidding documents and evaluate bidding documents for package No. 1: Construction of the project of the Headquarters, subject classrooms and auxiliary items of Tan Dan Secondary School.

The same team of experts evaluated all 5 projects.

3. Package No. 01: Construction of the Project to Renovate and Expand the Urban Planning Road (section from Nguyen Thien Thuat Secondary School - Kenh Dong) invested by the Khoai Chau District Construction Investment Project Management Board.

This bid package costs 19,346,478,000 VND and has one participating contractor, the Joint Venture of Son Hai Hung Phat Construction Company Limited and Tan Hung Construction Company participating in the bid.

The expert team was established by R-EMC Company based on Decision No. 28.4/2025/QD-TCG dated April 28, 2025 of R-EMC Company to prepare bidding documents and evaluate bidding documents for package No. 1: Construction of the project to renovate and expand the Urban Planning Road (section from Nguyen Thien Thuat Secondary School - Kenh Dong).

4. Package: Construction of Project: Multi-purpose building of Dong Tao Primary and Secondary School, invested by Dong Tao Commune People's Committee.

This bid package costs 8,787,225,000 VND. Like the 3 bid packages above, Tan Hung Construction Company still "alone" won the bid.

The expert team was established by R-EMC Company based on Decision No. 14.5/2025/QD-TCG dated May 14, 2025 of R-EMC Company to prepare bidding documents and evaluate bidding documents for the package: Construction of the Multi-purpose Building project of Dong Tao Primary and Secondary School.

5. Package: Construction of Project: Renovation and repair of 3-storey, 12-room classroom building and auxiliary items of Dong Tao Primary and Secondary School, invested by Dong Tao Commune People's Committee.

This bid package cost 7,879,986,000 VND and Tan Hung Construction Company participated alone and won the bid.

The expert team was established by R-EMC Company based on Decision No. 15.5/2025/QD-TCG dated May 15, 2025 of R-EMC Company to prepare bidding documents and evaluate bidding documents for the package: Construction of the project to renovate and repair a 3-storey, 12-room classroom building and auxiliary items of Dong Tao Primary and Secondary School.

The E-HSDT evaluation reports of all five projects used the same descriptive form, with no significant differences between each project, despite the differences in scale and content of work.

Notably, in all 5 packages, there was no competition from any other contractor – a rare occurrence in public bidding activities. Not only that, all 5 packages had a team of experts led by an officer named Vuong Duc Long and an employee named Nguyen Minh Tuyen as a team member.

The bid evaluation reports in all 5 projects use the same description form, with no significant differences between each project, even though the scale and content of the work are not the same. More specifically, all 5 Evaluation Reports have the same working method: “Working in a focused manner: Each member independently evaluates each assigned content for consideration; research by team members; then unifies the viewpoint, scoring method and overall evaluation results of the entire Consulting Team. Ensuring the selection of contractors with technical and financial capacity, experience and optimal construction techniques; with the lowest and most reasonable winning bid price.

Time to perform the tasks: Each task is performed in turn according to the evaluation steps stated in the bidding documents, ensuring the maximum evaluation time as prescribed.

Talking to reporters about this issue, Dr. Dang Van Cuong - Hanoi Bar Association said that the 2013 Bidding Law requires the contractor selection process to ensure competition, publicity, transparency and economic efficiency. However, all 5 bidding packages only had one contractor or consortium participating - a clear sign of lack of competition.

In addition, fixing a team of experts for many bidding packages and copying and stereotyping the evaluation report content shows the risk of organizing a formal bidding process, with the results possibly being "pre-made".

The lawyer said that it is necessary for the authorities to intervene to inspect the entire bidding process - evaluation - contractor selection, clarify the relationship between R-EMC Company and Tan Hung Company, as well as the independence of the bidding expert team.

In case of verification of intentional acts of creating advantages for a contractor, creating "tailor-made" records, or colluding in bidding, this may be a violation of Article 222 - Penal Code 2015 (amended 2017) of the crime of violating bidding regulations causing serious consequences with a penalty of up to 20 years in prison for individuals, and a ban on bidding activities for organizations.
