Khanh Hoa cancels 4 decisions approving land prices after 10 days of issuance

On August 30, according to Kinh te & Do thi, Mr. Le Huu Hoang - Vice Chairman of Khanh Hoa Provincial People's Committee signed a decision to cancel 4 decisions approving specific land prices of the Provincial People's Committee.

Specifically, Decision No. 2116/QD-UBND dated August 16, 2024 on approving specific land prices to calculate additional land use fees due to adjusting the architectural planning scheme of the Napoleon Castle I Apartment project at 25-26 Nguyen Dinh Chieu, Vinh Phuoc Ward, Nha Trang City.

Decision No. 2133/QD-UBND dated August 19, 2024 on approving specific land prices for calculating land use fees and land rents for the Le Hong Phong II New Urban Area project, Phuoc Hai ward, Vinh Hiep commune, Nha Trang city.

Decision No. 2151/QD-UBND dated August 20, 2024 on approving specific land prices to calculate land rent and pay annual land rent at land plot No. 02 Yersin Street, Xuong Huan Ward, Nha Trang City.

Decision No. 2161/QD-UBND dated August 20, 2024 on approving specific land prices for calculating land use fees and land rents for the Phuoc Long New Urban Area project, Phuoc Long ward, Nha Trang city.

The reason for canceling the above decisions is because the decisions issued based on legal documents have expired.

Regarding the above 4 decisions, on August 28, the Department of Natural Resources and Environment (DONRE) of Khanh Hoa province sent a document to the Provincial People's Committee on issuing specific land price decisions for specific land price application dossiers submitted before August 1, 2024.

According to the Department of Natural Resources and Environment, the Department submitted 4 land price plan dossiers to the Provincial People's Committee for decision before August 1, 2024. The Provincial People's Committee decided on specific land prices according to the submitted plan without applying the provisions of the 2024 Land Law.

The issuance of 4 decisions by the People's Committee of Khanh Hoa province approving specific land prices according to the documents submitted by the Department of Natural Resources and Environment before August 1, 2024 is in accordance with the provisions of Clause 3, Article 257 of the 2024 Land Law.

However, in the 4 decisions approving specific land prices of the Provincial People's Committee issued after August 1, 2024 (draft of the Department of Natural Resources and Environment submitted for signing before August 1, 2024), the legal basis for issuing the decision was based on the 2013 Land Law and the decrees and circulars guiding its implementation that have expired since August 1, 2024, which is inappropriate and should be canceled.

The Department of Natural Resources and Environment also said that currently, the Khanh Hoa Provincial Tax Department has not issued a notice to collect land use fees and land rents according to the issued decisions. Therefore, the Department of Natural Resources and Environment reports to the Provincial People's Committee to consider canceling the above land price approval decisions.

For the above-mentioned land plots, the approval of specific land prices is of utmost importance for the authorities to determine the financial obligations of the parties involved, as a basis for granting land use right certificates. The delay in approving specific land prices has lasted for many years, causing difficulties for investors and secondary investors in their financial planning.
