Prosecution of the man who drove his car into a patrol team, breaking the leg of a traffic police officer

On the afternoon of November 21, Bac Giang Provincial Police announced that Hiep Hoa District Police had just issued a decision to prosecute the case and prosecute Nguyen Bac Nam (born 2006, residing in Cam Hoang village, Xuan Cam commune, Hiep Hoa district) for the crime of "Resisting a person on official duty".

At around 7:40 p.m. on November 18, a working group of Hiep Hoa District Police set up a checkpoint to check alcohol concentration at Km 63 + 500, Provincial Road 295, in Dong Lam Village, Huong Lam Commune, Hiep Hoa District. The working group discovered 4 motorbikes moving in the direction from Thang Town to Mai Dinh Commune.

The traffic police on duty signaled to stop the vehicles and guided traffic participants to the controlled area reserved for motorbike lanes.

At this time, the motorbike with license plate 98D1-891.39 driven by Nguyen Bac Nam, followed by Nguyen Hoang Van (born 2006, residing in Cam Trung village, Xuan Cam commune, Hiep Hoa district) was running at high speed, both were not wearing helmets, did not obey the task force's order to stop, but instead drove the motorbike into the lane of the oncoming vehicle.

While fleeing, the motorbike crashed into the NVL soldier on duty, causing Mr. L. to fall and break his left leg.

After the collision, the working group took Mr. NVL and the two young men to the emergency room at Hiep Hoa District Medical Center, Bac Giang.

Article 330 of the 2015 Penal Code (amended in 2017) stipulates the crime of "Resisting a person on official duty" as follows:

Anyone who uses force, threatens to use force or uses other means to prevent a public official from performing his or her official duties or forces him or her to commit an illegal act shall be subject to non-custodial reform for up to 3 years or imprisonment from 6 months to 3 years.

Committing a crime in one of the following cases shall be punishable by imprisonment from 2 to 7 years:

- Organized;

- Committing the crime 2 times or more;

- Inciting, enticing, or inciting others to commit crimes;

- Causing property damage of 50 million VND or more;

- Dangerous recidivism.
