On November 1, the Legal Committee of the People's Council of Ca Mau province organized a supervision of the implementation of the law on handling administrative violations (VPHC) in the province.
According to the report of the People's Committee of Ca Mau province, from January 1, 2021 to June 30, 2023, there were 22,109 administrative violations in the province with 279 organizations and 24,609 individuals. The province issued 24,888 fine decisions with a total amount of over 99 billion VND.
In 3 years, Ca Mau had 5 officials disciplined in the work of enforcing the law on handling administrative violations.
Also according to the People's Committee of Ca Mau province, after 3 years of implementing Decree No. 19/2020/ND-CP, in the province, 1 commune People's Committee Chairman was disciplined by reprimand; 4 officials and civil servants were reviewed for experience (without disciplinary action) in the enforcement of the law on handling administrative violations.
During the monitoring session, many issues were raised by delegates such as: the detection of administrative violations in some fields is still slow, there are cases where when detected, they cannot be punished because the statute of limitations for punishment has expired or the violating individuals and organizations deliberately avoid cooperation. In the fields of environment and construction order, there are very few decisions to punish administrative violations, while in reality there are many violations.
In particular, it is very difficult to punish violations of regulations on military service. According to Clause 7, Article 1 of Decree 37/2022/ND-CP, those who violate regulations on military service will be subject to administrative fines of 30 - 75 million VND. However, these violators often have no assets, so the enforcement of the decision is very difficult and almost impossible.
Mr. Nguyen Son Ca, Head of the Legal Committee of the People's Council of Ca Mau province, Head of the monitoring delegation, requested that all levels continue to research, have more opinions, suggestions and recommendations, and the monitoring delegation will synthesize and report the results to the Standing Committee of the Provincial People's Council and the Provincial People's Committee. At the same time, report to the Central Committee on recommendations and proposals that need to amend and supplement some legal contents in handling administrative violations that are still inadequate and unclear so that the Government , ministries and central branches can guide localities to amend and supplement in the coming time.
