Kien Giang Province revokes 99 construction activity capacity certificates.

The People's Court of Kien Giang province has issued a verdict in the case of forging documents of agencies and organizations and requested the Department of Construction of Kien Giang province to revoke the capacity certificates granted to the relevant businesses.

On the afternoon of November 5th, the Propaganda Department of the Provincial Party Committee, in coordination with the Department of Information and Communications of Kien Giang province, held a regular press briefing.

The meeting provided information on matters related to complaints and denunciations concerning the revocation of 99 construction activity capacity certificates of various organizations.

Mr. Nguyen Ngoc Lan, Deputy Director of the Department of Construction of Kien Giang province, provided information regarding the revocation of 99 construction activity capacity certificates.

Mr. Nguyen Ngoc Lan, Deputy Director of the Department of Construction of Kien Giang province, said that after the Kien Giang Provincial People's Court issued judgment No. 38/2023 declaring defendants Le Quyet Tien and Nguyen Hoang Khanh guilty of forging documents of agencies and organizations.

The verdict recommends that the Department of Construction of Kien Giang province revoke the capacity certificates issued to the businesses for which the two defendants falsified documents when submitting applications, as requested by the Kien Giang Provincial Police Investigation Agency.

According to Mr. Lan, based on Decision No. 877 dated November 22, 2023, of the High People's Court in Ho Chi Minh City and Official Letter No. 1307 dated July 25, 2024, of the investigative police agency - Kien Giang Provincial Police, on September 18, 2024, the Department of Construction issued a decision to revoke 99 construction activity capacity certificates.

"After the Department of Construction issued the decision to revoke the construction activity capacity certificates, the Department received 35 complaints and one denouncement via mail related to the revocation of 99 construction activity capacity certificates," Mr. Lan said.

According to Mr. Lan, none of the applications clearly stated the full name or contact address… The Department has instructed its specialized departments to check and verify the information.

The department contacted 35 businesses listed on the petition directly by phone. 28 responded, confirming they had not submitted the petition, while the rest could not be reached.

To date, 35 out of 99 construction activity capacity certificates from organizations have been submitted to the Department of Construction, and 10 businesses could not receive the revocation decision (due to company dissolution, unreachable phone numbers, address changes, frequent closures, etc., with return labels from the post office).

Mr. Lan stated that the Department of Construction's revocation of the construction activity capacity certificate is in accordance with government regulations. To date, no organization or individual has filed a complaint against the department's decision to revoke the certificate.

In June 2023, the People's Court of Kien Giang province sentenced Le Quyet Tien (34 years old), former civil servant of the Construction Management Department of the Kien Giang Provincial Department of Construction, to 2 years in prison; and Nguyen Hoang Khanh (40 years old), former specialist of the Inspection Department of the Kien Giang Provincial Department of Planning and Investment, to 1 year in prison. Both were convicted of forging documents of agencies and organizations.

Accordingly, some businesses in the province that did not meet the requirements to apply for a construction capacity certificate contacted Tien and Khanh to "ask" them to prepare the application for the construction certificate. For each completed application, the businesses paid Tien or Khanh between 10 and 20 million VND.

The police determined that from 2018 to January 5, 2022, Le Quyet Tien helped businesses that did not meet the requirements to obtain construction certificates for 99 applications from 75 businesses.
