According to the first instance judgment No. 233/2025 of the Ho Chi Minh City People's Court related to the case of Vinafood II transferring the land plot at 132 Ben Van Don (District 4, Ho Chi Minh City) against regulations to Vinh Hoi Company, the Ho Chi Minh City People's Court proposed to cancel the measures to prevent the transfer transaction at land plot No. 132 Ben Van Don.
Specifically, according to the verdict, the trial panel held that the fact that Phu My Hung Investment Joint Stock Company was a third party that bona fide received the transfer of land use rights and implemented the project, was granted a land use rights certificate by the competent authority, and was licensed to implement the project at land plot No. 132 Ben Van Don (Ward 6, District 4, Ho Chi Minh City) and transferred it to the buyer at the project were independent civil relationships and transactions, unrelated to the criminal acts of the defendants in this case.
Therefore, the trial panel recommended that the Ho Chi Minh City People's Committee cancel the measures to prevent the transfer transaction at land plot No. 132 Ben Van Don (Ward 6, District 4, Ho Chi Minh City) applied at the request of the Ministry of Public Security's Investigation Agency.
Speaking to Tuoi Tre Online , a representative of Phu My Hung Investment Corporation said that this ruling once again affirms the legal transparency and independence of Phu My Hung Investment Corporation in the process of investing, developing and trading the Millennium project. At the same time, it protects the legitimate rights and interests of home buyers, partners and parties related to the project.
Meanwhile, residents at the Millennium apartment project "breathed a sigh of relief" because they will be able to expedite procedures for issuing pink books after many years of living stably but "without" pink books.
Previously, the Ho Chi Minh City People's Committee temporarily suspended the settlement of land use rights conversion, transfer, lease, inheritance, donation, and mortgage at land plot No. 132 Ben Van Don at the request of the Ministry of Public Security's Investigation Police Agency.
Phu My Hung Investment Corporation once issued a document stating that the company sold the project's products and handed over apartments to customers in accordance with legal regulations, and did not violate the law during the project implementation process at the land plot at 132 Ben Van Don.
In addition, both Phu My Hung Investment Corporation and Phat Dat Real Estate Development Corporation have affirmed that the implementation process of the 132 Ben Van Don project is not related to individuals or leaders of Vinafood II Company.
As reported by Tuoi Tre Online , the People's Court of Ho Chi Minh City sentenced 6 defendants in the case of Vinafood II transferring the land plot at 132 Ben Van Don (District 4, Ho Chi Minh City) to Vinh Hoi Company in violation of regulations, causing damage to the State of more than 113.7 billion VND.
In particular, the court ordered Nguyen Kim Company to pay more than 68 billion VND to the representative of the state capital at Vinafood II. At the same time, the court ordered the state budget to add the amount the defendants paid to remedy the consequences.
