Voters in Quang Ngai province have just sent a petition to the Ministry of National Defense regarding the salary scale policy for the position of commune-level military commander (commune team leader).
According to the reflection, commune military leaders who studied at universities outside the army are not entitled to university salaries. Voters suggested that the Ministry of National Defense coordinate with the Ministry of Interior to amend the law on the titles of commanders and deputy commanders of commune-level military commands so that localities can apply it consistently.
Responding to voters, the Ministry of National Defense said that the Law on Militia and Self-Defense Forces has stipulated the training of commune-level military command chiefs. Accordingly, this position must be trained as commune-level military command chiefs in the basic military sector at intermediate, college or university level at a military school.
Decree 33/2023 of the Government on salary classification for commune-level cadres and civil servants also stipulates that in case during their working period, commune-level cadres and civil servants have changes in their training level in accordance with their current position or title, they can request the Chairman of the District People's Committee to classify their salary according to their new training level from the date of being granted a graduation certificate.
Circular 04/2022 of the Ministry of Home Affairs also stipulates that the professional qualifications for commune-level officials and civil servants are university degrees or higher in a training field suitable for the requirements of the tasks of each commune-level civil servant position, except where otherwise provided by law.
Thus, legal documents regulating professional qualifications, training and salary scales for cadres and civil servants in general and commanders and deputy commanders of military commands in particular are relatively consistent and unified. On the other hand, the basic military sector is a specialized sector, trained at military schools.
"Therefore, if the commune-level commander has been trained and graduated from university with a major suitable for his/her professional expertise, the competent authority will consider granting him/her university salary according to regulations," the Ministry of National Defense replied to voters.
