Seeking comments on the Draft Law on Urban and Rural Planning

On the morning of May 15, the Provincial National Assembly Delegation coordinated with the Department of Construction to organize a conference to collect comments on the Draft Law on Urban and Rural Planning.

Comrades: Sung A Lenh, Deputy Head of the Provincial National Assembly Delegation; Phi Cong Hoan, Director of the Department of Construction co-chaired the conference.

Attending the conference were leaders of a number of departments, branches, localities in the province and provincial National Assembly delegates.

Speaking at the opening of the conference, Comrade Sung A Lenh, Deputy Head of the Provincial National Assembly Delegation, emphasized: The 2009 Urban Planning Law and the 2014 Construction Law have overcome some previous shortcomings and inadequacies; contributing to ensuring the unity, synchronization, transparency, feasibility, completeness and effectiveness of the legal system on planning. The legal regulations have been effective in promoting economic and social development, investment, construction, urban and rural development, creating a living environment, meeting the needs of the people.

However, in the process of implementation, there have been limitations and shortcomings that need to be studied, revised, supplemented and improved. From the above reality, with the requirements of urban and rural development in the new period, it can be seen that the promulgation of the Law on Urban and Rural Planning is very necessary to institutionalize the leadership orientation of the Party, at the same time unify the legal provisions on planning in urban and rural areas in one set of laws, creating favorable conditions for organizing implementation and effective management.

The Draft Law on Urban and Rural Planning is designed with 5 chapters and 61 articles, specifically: Chapter I: General provisions (15 articles), Chapter II: Establishment, appraisal, approval and adjustment of urban and rural planning (27 articles), Chapter III: Organization of urban and rural planning management (9 articles), Chapter IV: Contents and responsibilities of state management of urban and rural planning (7 articles), Chapter V: Implementation provisions (3 articles)

Next, the delegates contributed 9 opinions to the draft law. The opinions basically agreed with the structure and main content and believed that the draft law had resolved a number of issues that existed in the previous period, such as more clearly defining “functional areas”, “validity period”, “new urban planning”, “funding for planning”…

The delegate also proposed to consider adjusting and supplementing some contents of the articles, such as: Studying the scope of determining urban areas including only the inner city of the city, the inner city of the town and township (Clause 1, Article 2); clarifying further the establishment of zoning plans for existing urban areas that have been invested in and built synchronously in terms of social infrastructure, technical infrastructure and architectural works before being recognized as type II urban areas and new urban areas with a forecasted population size equivalent to the population size of type II urban areas or higher (Clause 2, Article 3), and at the same time proposing to supplement the content according to the idea "for existing urban areas that have been invested in and built synchronously in terms of social infrastructure, technical infrastructure and architectural works, it is not mandatory to establish zoning plans".

Regarding Articles 33 and 34 of the draft, delegates proposed to study the direction of removing the part of collecting public opinions for the tasks of general planning and zoning planning because in reality, at this step, people's participation in giving opinions is very limited.

In Article 33, the consultation of state management agencies, organizations and experts is stipulated in both the planning and planning appraisal steps. It is proposed that the study only stipulate this in the planning step, with the aim of reducing procedures and speeding up the progress of planning. The delegate also proposed to review the contents of Articles 33 and 34 to ensure consistency in implementation. The delegate suggested to study and clarify the necessity of establishing an Appraisal Council (Article 36)...

The opinions of delegates at the conference will be compiled by the Provincial National Assembly Delegation, continued to be studied and proposed for adjustment and supplementation to contribute to the completion of the draft Law to report to the National Assembly in the next session.
