Circular No. 05/2025 issued by the Ministry of Education and Training , effective from April 22, stipulates that annual leave for principals, vice principals, and teachers includes summer vacation, holidays, Tet, and other holidays as prescribed by the Labor Code and the Law on Social Insurance.
Specifically, the annual summer vacation for teachers of preschools, generaleducation institutions, and specialized schools is 8 weeks, including annual leave.
Meanwhile, the annual summer vacation for secondary school teachers and college lecturers is 6 weeks, including annual leave. Lecturers at higher education institutions are entitled to leave according to the regulations on organization and operation of higher education institutions.

Based on the school year plan, scale, characteristics, and specific conditions of each school, the principal arranges teachers' annual leave appropriately, in accordance with regulations, ensuring the school year time frame.
In sudden, urgent cases to prevent natural disasters, epidemics or urgent cases, summer vacation time for teachers of preschools, general education institutions, specialized schools, secondary schools and colleges is decided by competent authority.
However, during the summer vacation, when summoned by competent authorities, teachers still participate in training and development according to job requirements, participate in high school graduation exams, and enrollment.
Similarly, the summer vacation of the principal and vice principal is flexibly arranged during the school year and during the summer vacation of teachers to ensure that school activities take place normally and that work tasks convened by management agencies at all levels (if any) are completed.
Summer vacation coincides with maternity leave
In case the summer vacation and maternity leave of female teachers overlap, in addition to the leave prescribed above, the teacher's leave includes: Maternity leave according to regulations; Summer vacation outside of maternity leave (before or after maternity leave).
If the summer vacation time in addition to maternity leave is less than the number of annual leave days prescribed by the Labor Code, the teacher is entitled to additional days off. Additional leave time is flexibly arranged according to the agreement between the teacher and the principal.
Along with that, Clause 3, Article 6 of Circular 05/2025 stipulates that male teachers are entitled to maternity leave when their wives give birth according to the provisions of the Law on Social Insurance. During the maternity leave, male teachers are considered to have taught enough teaching hours according to regulations and do not have to make up for it.
However, in case the male teacher's maternity leave when his wife gives birth coincides with the summer vacation, he will not be allowed to take compensatory leave.
Thus, from April 22, during the maternity leave when the wife gives birth according to regulations, male teachers are still counted as teaching enough hours and do not have to make up for it. At the same time, if the maternity leave when the wife gives birth of a male teacher coincides with the summer vacation, he will not be allowed to take compensatory leave, unlike female teachers.
