Receiving citizens at home and receiving citizens in the electronic environment, possibly via zalo messages... that is a new way of receiving citizens and handling citizens' petitions.

That was the opinion of Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs Le Tan Toi speaking at the discussion session at the National Assembly Standing Committee on the morning of October 13, giving opinions on the Draft Law amending and supplementing a number of articles of the Law on Citizen Reception, the Law on Complaints, and the Law on Denunciations.

According to the Government's Report on the practical basis of the draft Law amending and supplementing a number of articles of the Law on Citizen Reception, the Law on Complaints, and the Law on Denunciations, the process of reorganizing the apparatus of the political system, implementing the model of organizing a 2-level local government, and arranging a system of inspection agencies to be streamlined, strong, efficient, effective, and efficient in the spirit of the resolutions and conclusions of the Central Executive Committee, the Politburo, and the Secretariat sets out the requirements to amend and supplement the Law on Citizen Reception, the Law on Complaints, and the Law on Denunciations to ensure consistency, synchronization, and suitability with reality. Through implementation, it has been shown that the Law on Citizen Reception 2013 (effective from July 1, 2014), the Law on Complaints 2011 (effective from July 1, 2012), and the Law on Denunciation 2018 (effective from January 1, 2019) have revealed limitations and inadequacies that need to be amended and supplemented to be suitable.

Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi expressed that there should be a national database on citizen reception, complaints and denunciations to ensure connectivity with competent agencies. According to Mr. Toi, the Government is currently implementing this content. Therefore, there needs to be unified direction, it is best to include this content in the scope of law to quickly promote the construction of a national database, creating a basis for implementation. This will bring great efficiency in the work of citizen reception, complaints and denunciations.

Currently, on information sites, fake petitions are sent to many places, even posted directly on Facebook or Zalo, causing a huge impact, affecting society and even affecting the reputation of individuals. At major events or during cadre congresses, information posted on social networks is very difficult to handle. Therefore, the Drafting Committee needs to research this issue.

“In reality, I see that when citizens make complaints or when receiving citizens, there are many cases where large crowds gather. Handling complaints is a regulated responsibility, but maintaining order when there is a crowd is the responsibility of the police. If anyone violates, they will be dealt with. However, there are crowds that we cannot handle immediately. If that crowd complains, petitions, or wants to achieve a certain wish that is in accordance with their psychology and the law, then arresting and handling them when they speak loudly can spread the complexity even more,” said Mr. Le Tan Toi.

According to Mr. Le Tan Toi, the responsibility of the police force, especially the grassroots police, cannot be resolved alone. “Therefore, I suggest that the Drafting Committee study and clearly stipulate the coordination mechanism for handling crowds in this Law. A very important issue is that when preparing to receive people, if a responsible person comes to calm and talk, the crowd can disperse. On the contrary, if the police force suppresses the situation more, the incident will become more complicated. Therefore, I suggest that you study this issue carefully,” said Mr. Le Tan Toi.

Regarding the form of citizen reception, many opinions completely agree with adding the form of online citizen reception and combining it with direct citizen reception.

Mr. Le Tan Toi said that recently when meeting voters and monitoring the situation, it showed that there are two very effective forms; that is, receiving citizens at home is very effective. Based on understanding the situation of complaints in the area, if the people are far away, the Chairman of the Commune People's Committee assigns leaders of departments and branches to go to the place to meet citizens, listen and resolve on the spot.

Next is to receive citizens in the electronic environment through the establishment of a Zalo group. The Chairman of the Commune People's Committee receives petitions from people posted on the group, then assigns and directly resolves them, and notifies the people.

"I suggest that the Drafting Committee further study these forms," ​​Mr. Le Tan Toi suggested.

However, the problem is that when complaints are posted on websites such as Facebook, Telegram or other websites, the content of the complaint can be spread very widely and greatly. After a period of time, if the complainant voluntarily withdraws the complaint, who will be responsible for the effects and damages that have occurred?

Concluding the discussion, Vice Chairman of the National Assembly Tran Quang Phuong stated that, regarding the scope of amendments, the National Assembly Standing Committee proposed to continue reviewing to fully assess the limitations and difficulties of the laws pointed out through the overall review process, ensuring the principles of amendments and supplements meet the requirements of the two-level local government organization and the real problems in practice.

The Vice Chairman of the National Assembly suggested that the Government soon complete the national database on citizen reception, complaint and denunciation settlement, ensuring connectivity between agencies, while at the same time being consistent with the provisions of the Law on Protection of State Secrets and related laws.
