The provincial chairman must directly receive people periodically and cannot delegate authority.

(Dan Tri) - According to Deputy Inspector General Le Tien Dat, the draft law and the current law do not stipulate authorization in receiving citizens. Instead, the head must directly receive citizens periodically.

The draft Law amending and supplementing a number of articles of the Law on Citizen Reception, the Law on Complaints, and the Law on Denunciations was commented on by the National Assembly Standing Committee at the meeting on October 13. This is one of the draft laws that will be submitted to the National Assembly for consideration and approval at the upcoming 10th session.

Regarding the new points in the draft law, Deputy Inspector General of the Government Le Tien Dat said that this draft adjusts the authority and responsibility in the work of receiving citizens, handling complaints and denunciations according to the new organizational model of local authorities, courts, procuracies and inspectorates.

Notably, the draft law adds provisions on online citizen reception.

According to the draft law, the chairman of the People's Committee at the commune level must directly receive citizens at the citizen reception location at least 2 days a month. The current law stipulates the responsibility of the chairman of the People's Committee at the commune level to receive citizens "at least one day a week".

Commenting on this content, Vice Chairwoman of the National Assembly Nguyen Thi Thanh stated that one of the reasons for the existence and limitations in handling complaints and denunciations in recent times is that responsible persons do not directly receive citizens but often delegate authority to their deputies, even in the situation of "authorization of authorization".

"This leads to prolonged petitions and cases, and some cases are not resolved as expected," Ms. Thanh said, suggesting considering authorization in receiving citizens.

Chairman of the Delegation Work Committee Nguyen Thanh Hai also proposed that the law clearly stipulate "receiving citizens without authorization".

According to her, the law stipulates that the Chairman of the Provincial People's Committee must receive citizens once a month, then he must receive, listen and direct the agencies to resolve the issue, avoiding the situation where the Chairman authorizes the deputy, and then the deputy authorizes the latter.

"The responsibility of the leader is very high and the decision-making authority of the leader is very important, so it is necessary to legalize the requirement that absolutely no delegation of authority is allowed," Ms. Hai stated her opinion.

She pointed out that in the past, when supervising citizen reception and handling of complaints and denunciations in provinces and cities, she found that many delegations of authority affected the quality of citizen reception.

“People have to travel a lot because they cannot meet the leader, while if they could meet the leader, it would only take 15-20 minutes to resolve the issue,” said Ms. Hai.

From a local perspective, Vice Chairwoman of the Hanoi People's Council Pham Thi Thanh Mai proposed to stipulate a minimum number of meetings a provincial and commune chairperson must have with citizens in a month, and in addition, they can delegate or authorize to resolve cases on a case-by-case basis.

"Such a regulation ensures the principle that the chairman must receive citizens, but also ensures flexibility," Ms. Mai stated.

The representative of the drafting agency, Deputy Inspector General Le Tien Dat, affirmed that the spirit of the draft law is "no authorization in receiving citizens". "The head must periodically receive citizens. The provisions of the current law are the same", he emphasized.

Clarifying the regulation on regular citizen reception by the Chairman of the People's Committee at the commune level twice a month, the Deputy Inspector General of the Government said that such a regulation is to suit the reality. Because according to the two-level local government model, the commune level has a large, wide scope of management and a lot of work.

"If there is no regulation that the Chairman of the Commune People's Committee must receive citizens at least twice a month, it will easily lead to a situation of delegation of authority," Mr. Dat said.

Concluding the discussion, Vice Chairman of the National Assembly Tran Quang Phuong stated that when it is stipulated that the chairmen of the provincial and communal People's Committees receive citizens one or two days a month, they cannot be authorized. However, in dealing with specific cases, the head can authorize.
