Reporting on a number of major issues of explanation, acceptance and revision of the Capital Law Project (amended) at the 5th Conference of full-time National Assembly deputies, Chairman of the Law Committee Hoang Thanh Tung said that regarding the organization of urban government, based on the opinions of National Assembly deputies, the Standing Committee of the Committee and agencies have agreed to accept and revise the regulations on the model of urban government organization in Hanoi ; the organizational structure, tasks and powers of the People's Council and People's Committee of Hanoi, districts, towns, cities under the City and People's Committees of wards.
"The content of accepting and adjusting regulations on organizational structure shows strong decentralization for Hanoi, helping the city government to be more proactive in organizing the apparatus and staffing to be able to effectively undertake the very special role and task of being the capital" - Chairman of the National Assembly's Law Committee said.
Regarding the content of decentralization of the organization of specialized agencies under the Hanoi City government (Article 9), the Standing Committee of the Law Committee and Hanoi City proposed to adjust in the direction of: assigning the City People's Council to stipulate criteria for establishment and decide on the establishment, reorganization, and dissolution of specialized agencies and other administrative organizations under the City People's Committee; stipulate the organization, number framework, and criteria for establishing specialized agencies and other administrative organizations under the People's Committees of districts, towns, and cities under the City (Clause 4, Article 9) to ensure proactiveness and timeliness in meeting the requirements of state management in the area in each period in order to build and perfect the apparatus capable of performing the tasks and powers that are decentralized and supplemented.
The majority of delegates said that the Basic Law Project closely follows the spirit of the Party's resolutions, the absorption and adjustment have absorbed the experience of specific mechanisms that have been and are being applied to localities; many policies are breakthroughs, demonstrating the spirit of decentralization and delegation of power to the Capital with the aim of building a civilized, modern, fast-developing and sustainable Capital.
Discussing the Draft Law, related to the decentralization regulations on the organization of specialized agencies under the Hanoi City government in Article 9, National Assembly delegate Pham Van Hoa (Dong Thap delegation) agreed with the regulation allowing the Hanoi City People's Council to establish specialized agencies.
However, according to the delegate, it is also necessary to stipulate criteria for establishment and decide on the establishment, reorganization, and dissolution of specialized agencies and other administrative organizations under the City People's Committee; stipulate the organization, number framework, and criteria for establishing specialized agencies and other administrative organizations under the People's Committees of districts, towns, and cities under the City to ensure proactiveness and timely response to the requirements of state management in the area in each period. At the same time, according to the delegate, having a maximum framework for the number of specialized agencies in Hanoi will avoid arbitrary cases, establishing as many as desired.
National Assembly delegate Le Thanh Van (Ca Mau delegation) said that, with the characteristics of Hanoi, it is necessary to add 1 article on the organization of specialized agencies of the People's Committee; giving the city the right to organize specialized agencies. In addition to the rigid framework prescribed by the Government, Hanoi is allowed to organize specialized agencies in accordance with its conditions and characteristics. "The "hard" part is the mandatory agencies according to Government regulations such as the police, army, internal affairs, justice, which are authoritarian in nature, while the agencies related to society, education, and health are assigned to Hanoi to decide according to the Government's criteria" - delegate Le Thanh Van proposed.
Along with the above views, some delegates pointed out that the authority to give the Hanoi People's Council the initiative in establishing, reorganizing, and dissolving relevant agencies and organizations is too great. Note that this is a new issue, and it is recommended that there should be a summary assessment before regulation.
Delegates also said that the regulations on the establishment, dissolution and reorganization of Hanoi agencies are not limited by the regulations of the Government and the Prime Minister on the functions, tasks and powers of specialized agencies and other administrative organizations, which can easily lead to an increase in staffing. Therefore, this issue should be piloted and comprehensively assessed and summarized before being regulated in the law, and it is necessary to supplement regulations on the conditions for establishing new agencies and organizations to ensure staffing and the ability to meet the budget.
