Pilot project to empower Hanoi to proactively organize specialized agencies

Reporting on several major issues regarding the explanation, acceptance, and revision of the draft Law on the Capital City (amended) at the 5th Conference of National Assembly Deputies working in specialized committees, the Chairman of the Law Committee, Hoang Thanh Tung, stated that, regarding the organization of urban government, based on the opinions of National Assembly deputies, the Standing Committee and relevant agencies have agreed to accept and revise the regulations on the model of urban government organization in Hanoi ; the organizational structure, tasks, and powers of the People's Council and People's Committee of Hanoi City, districts, towns, cities under the City, and People's Committees of wards.

"The revised regulations on organizational structure reflect a strong decentralization of power to Hanoi, enabling the city government to be more proactive in organizational structure and staffing so that it can effectively fulfill its unique role and responsibilities as the capital city," said the Chairman of the National Assembly's Law Committee.

Regarding the content on decentralization of authority for the organization of specialized agencies under the Hanoi City government (Article 9), the Standing Committee of the Law Committee of Hanoi City proposes amendments as follows: assigning the City People's Council to regulate the criteria for establishment and decide on the establishment, reorganization, and dissolution of specialized agencies and other administrative organizations under the City People's Committee; regulating the organization, framework, number, and criteria for establishing specialized agencies and other administrative organizations under the People's Committees of districts, towns, and cities within the city (Clause 4, Article 9) to ensure proactive and timely response to the requirements of state management in the area in each period, in order to build and strengthen the apparatus capable of performing the tasks and powers that have been decentralized and further delegated.

The majority of delegates agreed that the draft law fundamentally adheres to the spirit of the Party's resolutions, and that the revisions have incorporated the experience of special mechanisms that have been and are being applied to localities; many policies are groundbreaking, reflecting the spirit of decentralization and delegation of power to the capital city, aiming towards building a civilized, modern, rapidly developing, and sustainable capital.

During the discussion of the draft law, regarding the regulations on decentralization of authority for the organization of specialized agencies under the Hanoi City government in Article 9, National Assembly representative Pham Van Hoa (Dong Thap delegation) agreed with the provision allowing the Hanoi City People's Council to establish specialized agencies.

However, according to the delegates, it is also necessary to regulate the criteria for establishing and deciding on the establishment, reorganization, and dissolution of specialized agencies and other administrative organizations under the Hanoi People's Committee; and to regulate the organization, number framework, and establishment criteria of specialized agencies and other administrative organizations under the People's Committees of districts, towns, and cities within the city to ensure proactive and timely response to the requirements of state management in the area in each period. At the same time, according to the delegates, establishing a maximum number of specialized agencies in Hanoi will prevent arbitrary establishment of as many as desired.

National Assembly representative Le Thanh Van (from Ca Mau province) suggested that, given Hanoi's unique characteristics, an additional article should be added regarding the organization of specialized agencies under the People's Committee; granting the city the right to independently organize these specialized agencies. In addition to the rigid framework stipulated by the Government, Hanoi should be allowed to organize specialized agencies that suit its own conditions and characteristics. "The 'rigid' part consists of agencies that are mandatory according to Government regulations, such as the police, military, internal affairs, and justice, which are specialized in nature. Agencies related to social affairs, education, and health should be left to Hanoi to decide according to Government criteria," Representative Le Thanh Van proposed.

In addition to the above viewpoints, some delegates pointed out that granting the Hanoi City People's Council the authority to proactively establish, reorganize, and dissolve related agencies and organizations is excessive. They noted that this is a new issue and suggested that a comprehensive assessment should be conducted before implementing regulations.

The delegates also argued that the regulation on the establishment, dissolution, and reorganization of Hanoi's agencies, which is not limited by the Government's or the Prime Minister's regulations on the functions, tasks, and powers of specialized agencies or other administrative organizations, could easily lead to an increase in staffing. Therefore, this issue should be piloted and comprehensively evaluated before being incorporated into the law. Furthermore, regulations should be added requiring that the establishment of new agencies and organizations ensure sufficient staffing and budgetary capacity.
