Recently, the General Department of Taxation (now the Department of Taxation) has issued specific instructions on how to handle cases where taxpayers discover cases of false declaration or false declaration of income.
A representative of the Tax Department shared: "This situation has been relatively common in the past when we have successfully developed the eTax Mobile application. Individuals can determine their tax obligations. From this eTax Mobile application, many individuals realize that they do not receive actual income from a unit but have declared and settled the tax or income payment from that unit.
Previously, when the tax authority had not upgraded the application, we required taxpayers to submit a document or work directly with the tax authority to commit and explain that there were no production, business or working activities at that enterprise.
However, for the convenience of taxpayers, the eTax Mobile application now has a subsystem so that taxpayers can directly reflect on the application. Upon receiving this reflection, our tax authority will be responsible, together with the taxpayer, to clarify whether or not there is income from the declared business for salary payment expenses."
Accordingly, in the case where an individual discovers that an enterprise uses personal information (name, tax code, citizen identification number) to declare and calculate salary and wage expenses when determining corporate income tax obligations while there is no actual income payment to the individual, affecting the data and personal income tax settlement obligations, the individual can send feedback electronically to the tax authority about the incorrect income declaration or false income declaration.
When taxpayers send feedback via eTax Mobile or ICanhan (https://canhan.gdt.gov.vn/ICanhan/Request), the system will automatically send feedback information to the email address of the reported enterprise, and at the same time send it to the tax authority managing the enterprise and the tax authority processing the taxpayer's file.
Based on the information provided by taxpayers, tax authorities promptly take measures to check and verify information and take strict measures against enterprises that use individuals' information to declare and calculate expenses while not actually paying income to individuals.
