Despite receiving orders from superiors, the Director of the Provincial Department of Health and the advisory team regarding the advance payment of test kits, defendant Nguyen Thanh Danh still frankly admitted his guilt in court, without blaming anyone: "The defendant was aware of his criminal behavior. In the process of performing his duties, the defendant unintentionally violated the law on bidding, and I hope the Trial Council will consider it."

But there is one thing Mr. Nguyen Thanh Danh still insists on, that is, he refuses the "kickback" money from Viet A. The fact that Mr. Nguyen Thanh Danh did not receive the money has been confirmed by Viet A.

Not only Mr. Nguyen Thanh Danh, Mr. Nguyen Hong Chuong - Director of Binh Duong Department of Health also did not receive bribes from Viet A.

The amount of money that Mr. Danh and Mr. Chuong did not receive, Le Trung Nguyen - a regional employee of Viet A Company - reported to Phan Quoc Viet and deposited into an individual's bank account, a total of 4.2 billion VND.

Refusing 4.2 billion VND is not easy, because "greed" is very convincing, very logical, just need to lack courage to listen immediately.

Mr. Nguyen Hong Chuong did not hold Viet A's money, so he was not prosecuted. If he had been greedy, he would have "lost his reputation". As for Mr. Nguyen Thanh Danh, although he had to stand before the jury and admit his wrongdoings, he did not suffer the same shame as those who held hundreds of thousands of dollars or millions of dollars.

Ministers Nguyen Thanh Long and Chu Ngoc Anh could not resist greed, but a department director and CDC director could do it.

There are also cases where the wife is greedy but the husband is not, like Mr. Vo Tuan Anh (husband of defendant Nguyen Thi Hong Tham, Chief Accountant of Nghe An CDC). Hearing his wife say she had taken money from Viet A , Mr. Tuan did not ask her how much money she had received but asked her to return all the money she had received. Then Mr. Tuan took his wife to find Viet A employees to return a total of 1.5 billion VND.

For the defendants who violated bidding regulations in the Viet A case, if they did not have negative motives and refused to accept bribes, the trial panel needs to consider and make an appropriate judgment, demonstrating the strictness and humanity of the law.
