(BGDT) - Recently, through monitoring many construction projects of residential areas, industrial parks, roads... in some localities in Bac Giang province, the monitoring delegation of the Standing Committee of the Provincial People's Council discovered a series of violations in the fields of investment, land, environment and construction.
Many problems and limitations
The monitoring delegation of the Provincial People's Council Standing Committee has just monitored a number of key projects in the province. These are the projects: General cargo port cluster, coal processing, mechanical equipment manufacturing complex, MDF wood production (Luc Ngan); technical infrastructure of residential area and regulating lake in Da Mai ward (Bac Giang city); new urban area (KDT) Ninh Khanh, Nenh town (Viet Yen); upgrading and renovating provincial road (DT) 292 (Lang Giang); construction and business of infrastructure of Yen Lu Industrial Park (Yen Dung).

Through monitoring, the common violation discovered is that localities have not strictly complied with the provisions of the law in compensation for site clearance (GPMB). Typically, at the project of the General Cargo Port Complex, Coal Processing, Mechanical Equipment Manufacturing Complex, MDF Wood Production invested by Thien Lam Dat Joint Stock Company. When reclaiming land and compensating for GPMB, Luc Ngan District People's Committee has not strictly complied with the provisions of the 2013 Land Law.
Specifically, the land recovery dossier lacked an extract of the land use planning map as prescribed. The district approved the compensation and support plan with errors; calculated the cost and paid compensation and support to a number of households and individuals who had transferred land use rights but did not have the required signed documents of the relevant parties. The process of establishing a dossier to verify the origin and type of land for a number of plots of land cleared by the people themselves did not have documents on land use rights as prescribed.
At the technical infrastructure project of the residential area and the regulating lake in Da Mai ward, the work of preparing land acquisition records and compensation plans for site clearance still had errors in inventory, ownership, and determination of land origin, leading to adjustments to the land acquisition decision and compensation plan. Similarly, at the project of upgrading and renovating Highway 292, the work of determining the list of compensation for perennial trees grown on rice fields in the compensation plan for some cases was not in accordance with regulations; the cost was miscalculated, leading to an increase in compensation costs.
This situation also occurs in Ninh Khanh New Urban Area, Nhenh Town. Local compensation and support for site clearance for some traffic and irrigation land plots have been adjusted from public land to stable land allocation, leading to increased compensation costs... Land acquisition and site clearance compensation for the project is 18 months behind schedule.
Not only are there violations in compensation for site clearance, most project investors are also behind schedule and violating the construction and environmental sectors. Mr. Vu Tan Cuong, Deputy Head of the Economic - Budget Committee (Provincial People's Council) pointed out that the investor has only completed 2/3 of the items of the project for the General Cargo Port Complex, Coal Processing, Mechanical Equipment Manufacturing Complex, and MDF Wood Production. The wood production workshop has not been built yet...
At the Ninh Khanh New Urban Area project, the investor has basically completed the leveling, sidewalk, roadbed, lighting, etc. items, and is constructing the water supply system while there is no decision on land use change and allocation, and no construction permit. At the same time, environmental protection measures have not been properly implemented, such as using 2-meter-high corrugated iron to cover the project area; and there has been no contract with a functional unit to collect, treat waste, and conduct periodic monitoring. The investor of the Yen Lu Industrial Park infrastructure construction and business project also constructed a number of works without a construction permit, and was fined 130 million VND by the Provincial People's Committee Chairman last April.
Urgent remedy
Many opinions said that the above situation happened first of all because the competent authorities of the districts and cities have not fulfilled their responsibilities and have not strictly complied with the regulations on compensation for site clearance, which led to violations. Through monitoring, members of the delegation pointed out that the handling of violations by the People's Committee of Viet Yen district against the investor implementing the Ninh Khanh new urban area project is still limited. Violations in the construction field at the Yen Lu Industrial Park infrastructure construction and business project were slow to be detected.
To rectify violations, through supervision, Comrade Lam Thi Huong Thanh, Permanent Vice Chairwoman of the Provincial People's Council requested localities to organize a review of the responsibilities of relevant collectives and individuals. At the same time, urgently overcome shortcomings and limitations, soon put the project into operation, and promote socio-economic development in the area. |
Regarding the violations of the project of General Cargo Port, Coal Processing, Mechanical Equipment Manufacturing Complex, MDF Wood Production, the representative of Luc Ngan District leaders admitted that they had not handled and corrected them in a timely manner. In addition to the above reasons, during the implementation process, the investors of the projects have not voluntarily and strictly complied with the provisions of the law.
It is known that the goal of implementing the projects is to contribute to promoting local socio-economic development. Through supervision, Comrade Lam Thi Huong Thanh, Permanent Vice Chairman of the Provincial People's Council, requested localities to review the responsibilities of relevant collectives and individuals. At the same time, strengthen inspection and urge investors to implement the remaining items of the project to ensure progress and quality according to regulations. Luc Ngan district seriously draws experience in managing and supervising the implementation of the project of the General Cargo Port Cluster, Coal Processing, Mechanical Equipment Manufacturing Complex, MDF Wood Production.
The district considers recommending to the Provincial People's Committee measures to handle if the investor continues to delay progress, exceeds the time limit for land use extension and has not yet put the land into use. The Bac Giang City People's Committee reviews the work of preparing land recovery records and preparing compensation plans for site clearance of the project to ensure compliance with legal regulations.
Mr. Nguyen The Thi, Vice Chairman of Luc Ngan District People's Committee, said that in the coming time, the locality will focus on directing specialized agencies and investors to promptly overcome shortcomings and limitations. In case the investor continues to implement the project behind schedule, the district will propose to the competent authority to revoke the project. The People's Committees of Bac Giang City and Viet Yen and Yen Dung districts are also reviewing and directing investors to correct errors, strictly handling violations, and urging investors to promptly complete the project and put it into operation.
