The Government Inspectorate has just announced the Inspection Conclusion on state management of irrigation, dykes, and natural disaster prevention and control at the Ministry of Agriculture and Rural Development (MARD).
According to the Conclusion, the Ministry of Agriculture and Rural Development together with ministries, branches, provinces and cities have made great efforts in advising on the promulgation of mechanisms, policies, forecasting the situation; allocating resources to repair and renovate dykes, strengthening irrigation systems to minimize damage caused by storms, floods, droughts, landslides, etc., contributing to the sustainable development of the agricultural sector. However, in the management process, there are still shortcomings, shortcomings and violations.
Notably, the Ministry of Agriculture and Rural Development established 7 new irrigation plans for a number of river basins, regions, and areas with a planning period of 12 years, exceeding 2 years, and not consulting the Ministry of Planning and Investment , which is not in accordance with regulations. The Ministry of Agriculture and Rural Development and the People's Committees of a number of provinces did not comply with legal regulations in establishing, appraising, approving, adjusting, and supplementing irrigation plans, leading to a lack of basis for implementing economic development plans because the planning period and the economic development plan period are not consistent with each other, and there is a lack of basis for approving investment policies for construction, management, exploitation, and protection of irrigation works.
According to the Government Inspectorate, the Ministry of Agriculture and Rural Development has approved the investment policy of 2 projects from Government Bonds; 46 component projects under the medium-term investment plan; the project to complete the bottom dike from km 10+200 to km 14+700 in Hanoi and the project to repair the key dike system in Thai Binh province when the dike planning of the provinces has not been approved and the dike planning in the 257 planning is not enough to determine investment projects, lacking the basis to manage investment projects to build, repair and upgrade dikes in the provinces according to the Law on Dikes.
According to the report of the Ministry of Agriculture and Rural Development, from 2018 to 2023, the Department of Dyke Management and Natural Disaster Prevention has advised the Ministry to issue and issue under its authority 460 documents with opinions on approval for the Provincial People's Committee to grant licenses according to regulations and opinions related to the use of river banks. However, there are 4 projects to build works on river banks when the Ministry of Agriculture and Rural Development has not yet commented on the contents related to flood drainage and dike safety to submit to the Prime Minister for approval; there are 3 illegal construction projects... Some provinces do not implement the opinions of the Ministry of Agriculture and Rural Development in approving project investment; lax management of dikes, when violations are detected, they are not handled resolutely and decisively, leading to projects still being implemented and existing.
There are still 1,015 outstanding cases of violations. When detecting violations of dike regulations, the People's Committees of the provinces (including Hanoi, Thai Binh, Bac Ninh, Nghe An, Dong Thap) did not strictly and thoroughly handle them; did not strictly implement the Prime Minister's Directives, affecting the safety of the dikes and narrowing the flood escape space.
The Government Inspectorate also pointed out that from 2018 to 2023, agencies under the Ministry of Agriculture and Rural Development conducted 8 inspections and examinations, however, some shortcomings and violations in state management of natural disaster prevention and control have not been detected and handled promptly. The responsibility belongs to the Ministry of Agriculture and Rural Development in directing the inspection and examination work...
Regarding the handling of responsibilities, the Government Inspector General recommends that the Prime Minister direct the Ministry of Agriculture and Rural Development and the Ministry of Planning and Investment, based on the Inspection Conclusion, to organize a review to handle responsibilities according to the regulations of the Party and the State for the collective and individual leaders of the Ministry related to shortcomings and violations. Direct the People's Committees of the provinces and cities: Hanoi, Bac Ninh, Thai Binh, Nghe An, Ha Tinh, Ca Mau, Dong Thap, Ha Nam, Ninh Binh, Thanh Hoa, Nam Dinh, Quang Ninh, Hai Duong, Bac Giang... to organize a review to handle the collective and individual responsibilities of the leaders of the People's Committees of the provinces and cities related to shortcomings and violations.
The Government Inspectorate recommends that during the process of inspection, examination, review and implementation of the Inspection Conclusion, if agencies, organizations and individuals assigned to perform the task discover any illegal acts with signs of crime, they should transfer the case to the investigation agency for consideration and handling in accordance with the provisions of law.
At the announcement of the Inspection Conclusion, Deputy Minister of Agriculture and Rural Development Nguyen Hoang Hiep said that based on the Inspection Conclusion, the Ministry's leaders have directed the Ministry's Inspectorate to draft a plan to implement the Inspection Conclusion. It is expected that in the first quarter of 2025, relevant collectives and individuals will be reviewed. Regarding institutional remedies, the Ministry will be allowed to extend longer than other contents because the upcoming merger of units will result in changes in legal documents and regulations.
