Accordingly, the privately owned part in an apartment building includes: The area in the apartment, including the balcony area and loggia attached to that apartment; Other areas in the apartment building recognized as privately owned by the apartment owner; The system of privately used equipment attached to the apartment or attached to other areas privately owned by the apartment owner, except for equipment under common ownership.

Common ownership of an apartment building includes: The remaining area of the apartment building other than the privately owned area; the community house of the apartment building;

Space and load-bearing structure systems, equipment used in common in apartment buildings include: frames, columns, load-bearing walls, house perimeter walls, apartment dividing walls, floors, roofs, terraces, corridors, stairs, elevators, emergency exits, garbage chutes, technical boxes and technical box perimeter walls (if any), power supply systems, water supply systems, gas supply systems, communication systems, radio, television, drainage, septic tanks, lightning arrestors, fire prevention and fighting systems and other parts not privately owned by apartment owners;

Technical infrastructure systems outside apartment buildings but connected to those apartment buildings, except for technical infrastructure systems used for public purposes or in cases where they must be handed over to the State or to the investor of the housing construction investment project for management according to approved project content;

Public works in the apartment building area but not in the case of investment and construction for business purposes or not in the case of having to be handed over to the State according to the approved project content include: common yard, flower garden, park and other works identified in the approved project content.

The areas and equipment under private ownership or common ownership must be clearly stated in the contract for sale or lease-purchase of a house or other areas in an apartment building; in case the contract for sale or lease-purchase of a house or other areas in an apartment building does not clearly state, the private ownership or common ownership shall be determined according to the above provisions.
