The National Assembly passed the Law on Cadres and Civil Servants (amended): Strengthening management and handling of violations after leaving work or retiring

On June 24, the National Assembly passed the Law on Cadres and Civil Servants (amended) with 418/423 delegates present in favor, accounting for 87.45% of the total number of National Assembly delegates. The new law emphasizes innovation in management methods and strict handling of violations, even when cadres and civil servants have retired or quit their jobs.

The revised law aims to manage cadres and civil servants based on job positions, performance and specific products. Salaries, bonuses and other incomes are received in accordance with the results and products of the job positions held.

In particular, the State will apply special mechanisms to attract, employ and reward talented people, including experts, scientists, jurists, excellent lawyers, excellent businessmen and excellent graduates and other high-quality human resources to work in agencies of the Party, the State, the Vietnam Fatherland Front, and socio- political organizations. At the same time, policies of employing and rewarding worthy people will be reserved for officials and civil servants with good political qualities, good ethics, outstanding capacity, innovative thinking, and outstanding achievements in public service.

Among the things that cadres and civil servants are not allowed to do (Article 14), it is worth noting the regulation: "Avoiding, evading, avoiding, or shirking in the performance of assigned duties and tasks; causing factionalism and disunity; voluntarily quitting or leaving work; participating in strikes; posting, disseminating, or speaking out false information that affects the image and reputation of the country, locality, agency, organization, or unit where one works."

Thus, "participating in a strike" is a prohibited act to ensure discipline, order and prestige of state agencies.

An important new point of the law is the strict handling of violations occurring during the working period, even when the cadres and civil servants have quit their jobs or retired.

Violators may be subject to criminal, administrative or disciplinary action, including reprimand, warning, removal from office, and other corresponding legal consequences depending on the nature and severity. The time for investigation, prosecution, and trial under criminal procedures will not be counted towards the statute of limitations for disciplinary action.
