New regulations on extra teaching and learning, what should teachers pay attention to?

The Ministry of Education and Training has just issued a circular regulating extra teaching and learning, stating cases where extra teaching and extra learning are not allowed.

Specifically, teachers and schools are not allowed to organize extra classes for primary school students, except in cases related to arts, sports, and life skills training.

Teachers who are teaching at schools are not allowed to teach extra classes outside of school for money from the students they are teaching. Teachers at public schools are not allowed to participate in the management and operation of extra classes outside of school but can participate in extra classes outside of school.

Regulations on extra teaching in schools

For extra teaching and learning in schools, it is only for 3 subjects, including: Students whose study results of the last consecutive semester are not satisfactory; Students selected by the school to foster excellent students; Final year students who voluntarily register to review for entrance exams and graduation exams according to the school's education plan.

Regarding the cost of organizing extra teaching and learning, these three subjects are the responsibility of the school to train and are included in the school's educational plan to meet the school's educational goals, ensuring the rights of all students to meet the program's requirements and not collect tuition fees from students.

Extra classes are arranged by subject for each grade; each class has no more than 45 students; in one week, each extra subject has no more than 2 periods (to ensure that it does not exceed the average number of periods of subjects according to the regulations of the general education program); extra classes are not arranged alternately with the timetable for implementing the main curriculum (to limit the negative effects of forcing students to take extra classes); extra classes are not taught in advance compared to the subject curriculum distribution in the school's education plan.

Teachers who teach outside of school must register their business.

For extra teaching and learning outside of school that collects money from students, organizations and individuals must register their business to be subject to management according to the provisions of the Enterprise Law.

Business organizations and individuals must also increase publicity on the electronic information portal of the tutoring facility or post at the tutoring facility information about the subjects; the duration of tutoring for each subject by grade level; the location, form, and time of tutoring and learning; the list of tutors and the tuition fees before enrolling students.

Teachers who are teaching at schools and participate in extracurricular tutoring must report to the principal about the subjects, location, form, and time of extracurricular tutoring. The amount of tuition collected outside of school is agreed upon between the parents, the student, and the tutoring facility.

Regarding the supervision of extra teaching and learning, the circular stipulates that supervision must not only be done by the education sector or local authorities, but also by the entire population, by students and parents themselves, based on the issued regulations.

Previously, speaking at the opening session of the 8th Session of the 15th National Assembly (October 21), General Secretary To Lam requested a change in thinking about law-making, including a resolute abandonment of the mindset of "if you can't manage it, then ban it."

Also at this Session, when discussing the draft Law on Teachers, many National Assembly delegates affirmed that extra teaching and learning is a real need of society and the state management responsibility of the Ministry of Education and Training is to issue regulations to manage this issue.

The Ministry of Education and Training said that the Circular on extra teaching and learning is built on the viewpoint that the organization of extra teaching and learning must ensure that it does not affect the organization and implementation of the school's educational program and ensure the interests of students, preventing risks that lead to the situation where students, despite not having the desire or need, still have to attend extra classes organized by schools and teachers.
