On January 22, at the Government Headquarters, Deputy Prime Minister Tran Hong Ha chaired a meeting with leaders of a number of relevant ministries and branches on the implementation plan of the Land Law (amended) recently passed by the National Assembly at the 5th extraordinary session on January 18, 2024.

Land Law creates development

At the meeting, Deputy Prime Minister Tran Hong Ha emphasized that land and land management are large, important, and complicated fields, related to all aspects of economic, political , cultural, security-defense life and are of concern to every citizen... The completion of land policies and laws always receives special attention from Party and State leaders.

To date, the Land Law (amended) has been passed at the recent 5th extraordinary session. This is a large and important law, supported and passed by National Assembly deputies with a very high rate and is the central legal event of the term.

“On behalf of the Government and the Prime Minister , we would like to express our gratitude and support to the leaders of the Party, the State, the National Assembly, the Vietnam Fatherland Front, the agencies of the National Assembly, and the National Assembly Deputies for their work in the spirit of “early on, from afar”, working together and taking responsibility for the implementation of the law, fully absorbing the will and aspirations of all classes of people into the law. The law, once passed, will contribute to resolving many current problems and difficulties in land management; at the same time, contributing to creating future development with new and innovative thinking and perspectives,” Deputy Prime Minister Tran Hong Ha stated.

Therefore, after the Land Law (amended) is passed, the next issue is how to effectively implement the mechanisms and policies in the Law into life, making land a truly important resource, promoting land commercialization, contributing to the country's socio-economic development, ensuring security and national defense, etc.

Deputy Minister of Natural Resources and Environment Le Minh Ngan said that the Ministry has drafted a plan to implement the Land Law (amended) and submitted it to the Prime Minister for promulgation, assigning specific tasks to each ministry and branch to develop sub-law documents with specific progress; deploy training, propaganda, and dissemination of the content of the Land Law (amended), implementing documents; inspection and supervision work, etc.

At the meeting, leaders of the Ministries of Justice, Agriculture and Rural Development, Finance, Planning and Investment, etc. reported and discussed the roadmap and orientation for developing documents guiding the implementation of the Land Law (amended) within the scope of specialized management, as well as according to the provisions of the Law; and contributed opinions to the draft plan for implementing the Land Law (amended).

Ministries and branches must proactively propose Decrees and Circulars.

Emphasizing that the development of guiding documents is the top priority of the plan to implement the Land Law (amended), Deputy Prime Minister Tran Hong Ha requested the Ministry of Natural Resources and Environment to preside over and coordinate with the Ministry of Justice to review and submit to the Prime Minister a plan to issue guiding documents to implement the Land Law (amended): General Decree guiding general provisions and clauses; specialized fields (rice land management; land use fee collection; land valuation; recovery, compensation, resettlement; basic investigation of land data information, etc.); land for transport infrastructure, urban areas, energy, industry, etc.

Along with that is the project of policy communication, dissemination of law, bringing the provisions and regulations of the Land Law (amended) to be implemented and effectively applied in practice. At the same time, focus on training and dissemination to those working in land leadership and management from the central to local levels; perfecting and arranging the apparatus, building a database of land information to serve valuation work by 2025;... to ensure conditions for organizing the implementation of the Law.

The Deputy Prime Minister requested the assignment of specific responsibilities to ministries, branches, and localities in developing, perfecting, and promulgating, according to their authority, documents guiding the Land Law (amended), ensuring simultaneous, synchronous, and unified effectiveness.

Ministries and sectors need to carefully review the provisions of the Land Law (amended) that assign authority to the Government, the Prime Minister, and Ministers of ministries to regulate and guide implementation, in order to coordinate the development of a general guiding decree and a number of specific decrees with specific expertise. The general spirit is that the number of decrees must be minimal; the implementation and application of the law must be scientific and strict.

“Ministries and branches must carefully review and proactively propose the number of decrees assigned to be developed and detailed guiding circulars, which must be issued before the effective date of the provisions of the Law on April 1, 2024 and January 1, 2025, to have time to train, disseminate, and perfect the implementation organization,” the Deputy Prime Minister noted.

To synchronize and unify with a number of articles and clauses of the Land Law (amended) effective from April 1, 2024, the Ministry of Natural Resources and Environment urgently develops and submits to the Government a Decree regulating sea encroachment. The Ministry of Agriculture and Rural Development urgently updates new policies in the Decree amending and supplementing Decree No. 156 of the Government detailing the implementation of a number of articles of the Forestry Law.

To implement the provisions of the Land Law (amended) effective from January 1, 2025, the Ministry of Finance shall preside over the drafting of decrees related to the issue of money collection and issues related to land tax.

The Ministry of Agriculture and Rural Development is in charge of drafting decrees on guidelines for rice land use.

The Ministry of Natural Resources and Environment is in charge of drafting decrees detailing a number of articles of the Law; on compensation, support and resettlement, on basic investigation and land database, and sanctioning of administrative violations in the land sector;...

At the same time, relevant ministries and branches focus on developing documents under the decree, which are circulars guiding the implementation of the provisions of the Land Law (amended) this time.

The Ministry of Natural Resources and Environment has sent a document to localities to urgently review and issue detailed regulations according to their authority to create a synchronous legal corridor when the law comes into effect.

The Deputy Prime Minister assigned the Ministry of Natural Resources and Environment and the Ministry of Planning and Investment to preside over and coordinate the development of two pilot projects according to the Resolution of the National Assembly Standing Committee on separating the work of land acquisition, site clearance and resettlement from public investment projects; implementing commercial housing projects through agreements on receiving land use rights other than residential land in a number of localities with implementation capacity or special conditions according to specific criteria .
