The Department of Home Affairs has 35 duties and powers.

On June 19, 2025, the Ministry of Home Affairs issued Circular No. 10/2025/TT-BNV guiding the functions, tasks and powers of the Department of Home Affairs under the People's Committees of provinces and centrally run cities and the internal affairs field of specialized departments under the People's Committees of communes, wards and special zones of provinces and centrally run cities.

According to the Circular,   The Department of Home Affairs is a specialized agency under the People's Committee of a province or centrally-run city (hereinafter referred to as the provincial level), performing the function of advising and assisting the Provincial People's Committee in state management of: Administrative organization, state career; local government, administrative unit boundaries; cadres, civil servants, public employees and public service; administrative reform; associations, social funds, charity funds, non -governmental organizations; emulation and commendation; state documents and archives; youth; labor, wages; employment; social insurance; occupational safety and hygiene; meritorious people; gender equality and according to the assignment, decentralization or authorization of the Provincial People's Committee, the Chairman of the Provincial People's Committee according to the provisions of law.

The Department of Home Affairs has legal status, its own seal and account according to the provisions of law; complies with the direction and management of the Provincial People's Committee; and at the same time complies with the direction, guidance and inspection of professional expertise of the Ministry of Home Affairs .

35 tasks and powers of the Department of Home Affairs

The Department of Home Affairs has 35 tasks and powers, including: submitting to the Provincial People's Committee draft resolutions of the Provincial People's Council, draft decisions of the Provincial People's Committee related to sectors and fields under the management of the Department of Home Affairs and other documents as assigned by the Provincial People's Committee according to the provisions of law; draft plans for sector and field development; programs and measures to organize the implementation of sector and field tasks in the province under the management of the Department of Home Affairs; draft decisions on decentralization and delegation of state management tasks in sectors and fields to the Department of Home Affairs, specialized agencies, other administrative organizations under the Provincial People's Committee, People's Committees of communes, wards, and special zones (hereinafter referred to as commune level), Chairman of the Commune People's Committee, etc.

Regarding the organizational structure, the Department of Home Affairs submits to the Provincial People's Council for decision on the establishment, reorganization, renaming, and dissolution of specialized agencies and other administrative organizations under the Provincial People's Committee according to the provisions of law; Provides specific guidance on the order and procedures for establishing, reorganizing, and dissolving public service units under the Provincial People's Committee; Presides over and guides the Commune People's Committee to stipulate the functions, tasks, and powers in the field of internal affairs of the Department of Culture and Social Affairs under the Commune People's Committee; Directs agencies, organizations, and units to perform state management of non-public service units in the area according to the provisions of law.

The Department of Home Affairs reviews draft documents: Specifying the functions, tasks, powers and organizational structures of administrative agencies and public service units under the decision-making authority of the Provincial People's Committee and the Chairman of the Provincial People's Committee; ensuring the implementation of state management tasks in the field of home affairs within the functions, tasks, powers and organizational structures of administrative agencies at the provincial and communal levels; Establishing, reorganizing and dissolving administrative organizations, public service units and Management Councils in public service units under the decision-making authority of the Provincial People's Committee (except in cases where specialized laws provide otherwise); Establishing, consolidating, merging and dissolving inter-sectoral coordination organizations under the decision-making authority of the Provincial People's Committee and the Chairman of the Provincial People's Committee according to the provisions of law.

Regarding job positions, civil servant establishment , Department of Home Affairs   Advise and assist the Provincial People's Committee in deciding and managing job positions and civil servant staff according to assignment, decentralization and Party regulations and legal regulations;

Advise and assist the Provincial People's Committee in appraising, synthesizing and planning the annual or phased civil servant payroll; adjust the civil servant payroll of agencies and organizations of the People's Council, Provincial and Commune People's Committees and send it to the Ministry of Home Affairs according to the provisions of law;

Submit to the Provincial People's Council for decision on the number of civil servants of agencies and organizations of the Provincial People's Council, Provincial and Commune People's Committees within the total number of civil servants assigned by competent authorities; assist the Provincial People's Committee in implementing after being decided by the Provincial People's Council; submit to the Provincial People's Council the number of signed labor contracts for professional work at public service units in the area according to regulations;

Synthesize job positions and corresponding civil servant ranks of agencies and organizations of People's Councils and People's Committees at provincial and communal levels; submit to the Provincial People's Committee to send to the Ministry of Home Affairs according to the provisions of law.

On the implementation of salary, allowance and bonus regimes and policies for cadres, civil servants, public employees and contract workers in administrative agencies, organizations and public service units

The Department of Home Affairs decides according to decentralization or submits to the Chairman of the Provincial People's Committee to decide on regular salary increases, early salary increases and regimes and policies on salaries, allowances, bonuses and other regimes and policies as prescribed for cadres, civil servants, public employees and contract workers as prescribed by law and as prescribed by the Provincial People's Committee;

The Department of Home Affairs guides, inspects, resolves within its authority or proposes to competent authorities to resolve difficulties in the implementation of salary, allowance and bonus regimes and policies for cadres, civil servants, public employees, and contract workers in local administrative agencies, organizations, and public service units in accordance with the provisions of law and the provisions of the Provincial People's Committee.

In the field of employment

Department of Home Affairs   Organize the implementation of strategies, programs, long-term and annual plans, projects and proposals on employment, job creation support, labor market development, employment services, unemployment insurance, recruitment and labor management in Vietnam under the guidance of competent authorities; collect, store, synthesize, analyze, forecast, disseminate and manage local labor market information;

The Department of Home Affairs guides and implements policies to support job creation and unemployment insurance policies according to the provisions of law; guides and organizes the implementation of legal provisions on local employment services;

Approve the need to use foreign workers; confirm that work permits are not required; grant, re-grant, extend and revoke work permits for foreign workers working in Vietnam according to the provisions of labor law; Perform state management of foreign workers working in Vietnam under the management scope of the locality, etc.

Effective date

Circular No. 10/2025/TT-BNV takes effect from July 1, 2025.

This Circular replaces Circular No. 05/2021/TT-BNV dated August 12, 2021 of the Minister of Home Affairs guiding the functions, tasks and powers of the Department of Home Affairs under the Provincial People's Committee and the Department of Home Affairs under the District People's Committee and Circular No. 11/2021/TT-BLDTBXH dated September 30, 2021 of the Minister of Labor, War Invalids and Social Affairs guiding the functions, tasks and powers of the Department of Labor, War Invalids and Social Affairs under the Provincial People's Committee and the Department of Labor, War Invalids and Social Affairs under the District People's Committee.
